CITY OF NORTH OLMSTED ORDINANCE N0.2010 - 48 BY: Council Member Williamson & Council Member Orlowski AN ORDINANCE AMENDING THE TRAFFIC CONTROL FILE OF THE CITY OF NORTH OLMSTED TO PROVIDE FOR PROHIBITING THE STANDING OR PARKING OF MOTOR VEHICLES ON THE SDUTH SIDE OF PALM DRIVE AND BIRCH LANE (FROM 24163 PALM DRIVE THROUGH 23967 BIRCH LANE) BETWEEN THE HOURS OF 8:30 - 9:30 AM AND 3:1 S - 4:1 S PM, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the City Engineer, the Chief of Police, and the Director of Public Safety, following study and review, have found and determined that the standing or parking of motor vehicles on the south side of Palm Drive and Birch Lane (from 24163 Palm Drive through 23967 Birch Lane) when children are coming to or leaving from Birch School poses a safety hazard for children, and accordingly have recommended to this Council that the standing and parking of motor vehicles on the couth side of Palm Drive and Birch Lane (the streets merge together) at this location be prohibited on school days during the hours of 8:30 - 9:30 AM and 3:15 - 4:15 PM; and WHEREAS, this Council, based upon those findings and expert opinions, has determined that it is in the best interest of the safety, health and welfare of the citizens of the City of North Olmsted to prohibit the standing and parking of motor vehicles on the south side of Palm Drive and Birch Lane, from 24163 Palm Drive through 23967 Birch Lane, on school days between the hours of 8:30 - 9:30 AM and 3:15 - 4:15 PM, and accordingly, by the adoption of this ordinance, desires to do so; and WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the Traffic Control File, which file can be amended only by ordinance duly adopted by this Council; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND THE STATE OF OHIO: SECTION 1: That the Police Department be and the same is hereby authorized and directed to amend the Traffic Control File of the City of North Olmsted to indicate thereon the installation cf signs prohibiting the standing or parking of motor vehicles on the south side of Palm Drive and Birch Lane, from 24163 Palm Drive through 23967 Birch on school days between the hours of 8:30 - 9:30 AM and 3:15 - 4:15 PM. SECTION 2: That the Mayor be and he is hereby authorized to cause appropriate signs to be installed on Palm Drive and Birch Lane in accordance with the provisions of this Ordinance and the Ohio Manual of Uniform Traffic Control Devices.
