CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 50 <br />BY: Council Member Orlowski <br />AN ORDINANCE AMENDING SECTIONS 1373.01 AND 1373.02 OF <br />CHAPTER 1373 OF THE BUILDING CODE, ENTITLED <br />"BUILDING, ZONING, PROPERTY MAINTENANCE AND OTHER <br />NUISANCE ACTIVITIES," IN ORDER TO PROVIDE FOR THE <br />ABATEMENT OF PUBLIC NUISANCES AND THE RECOVERY OF <br />CITY RESPONSE COSTS INCURRED AS THE RESULT OF THE <br />MULTIPLE RECURRENCE OF SUCH NUISANCE ACTIVITIES ON <br />COMMERICAL PROPERTY LOCATED IN THE CITY OF NORTH <br />OLMSTED, AS AMENDED. <br />WHEREAS, public nuisance activities conducted in commercial areas of the City <br />of North Olmsted adversely affect the health, safety and welfare of residents and property <br />owners in the City of North Olmsted; and <br />WHEREAS, such public nuisance activities, particularly when they are permitted <br />to continue or recur on commercial properties within the City of North Olmsted, <br />negatively affect property values in and the occupancy rate of retail space of the City's <br />commercial districts, as well as the quality of life for individual residents in the City; and <br />WHEREAS, such public nuisance activities, if ignored or left unaddressed, lead <br />to the deterioration of commercial areas and the increased vacancy of retail space in the <br />City; and <br />WHEREAS, the City accordingly has an interest in the abatement of such public <br />nuisances in an effective way in order to protect the health, safety and welfare of the <br />City's residents and property owners; and <br />WHEREAS, owners of property who create, maintain, permit or otherwise suffer <br />to exist public nuisances on their property located within the City of North Olmsted on <br />multiple occasions cause the City to expend out of the ordinary general fund resources, in <br />the form of multiple safety and/or service department responses, in order to abate such <br />nuisances; and <br />WHEREAS, this Council has been generally informed by the Department of <br />Public Safety regarding the costs incurred by the City in responding on multiple <br />occasions to the same commercial properties in the City in order to address building and <br />zoning code violations and/or property maintenance nuisance activities; and <br />
