CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 51 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING BUILDING CODE SECTION 1317.04 OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED TO <br />REQUIRE, UPON REGISTRATION OR LICENSING OF CONTRACTORS, <br />EVIDENCE OF COMPLIANCE WITH STATE AND FEDERAL LEAD- <br />BASED PAINT CERTIFICATION FOR PAINTING AND WINDOW <br />REPLACEMENT, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Environmental Protection Agency (EPA) has adopted regulations <br />entitled Renovation, Repair and Painting (RRP) Rules, effective April 22, 2010, which require <br />contractors to be certified in safe work practices for lead-based paint in order to prevent lead <br />contamination, specifically in the performance of such painting or window replacement work in <br />homes, child care facilities or schools built before 1978; and <br />WHEREAS, it is the desire of this Council to amend Building Code Section 1317.04 of <br />the Codified Ordinances of the City of North Olmsted, in connection with registration or <br />licensing of contractors, to require evidence of compliance with federal and state law standards <br />for certification of lead-based painting contractors, where applicable, and to thereby enable <br />enforcement of certification requirements for certain painting and window replacement projects. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1317.04, which currently reads as follows: <br />1317.04 APPLICATIONS. <br />(a) Forms. The Building Commissioner shall establish and direct the Building <br />Department on the use of uniform application forms for local license and registration certificates. <br />(b) Sworn Application. All applications for local licenses and registration certificates <br />for which a fee is prescribed, shall be sworn to by the applicant before a notary public. Upon <br />reasonable standards determined by the Building Commissioner, renewal forms may be exempt <br />from notarization. <br />(c) Registration Submittals. All applicants for a certificate of registration must <br />provide evidence of compliance with Ohio R.C. 1317.05, which shall be deemed satisfactory <br />upon the presentation of documentation demonstrating a current license or certificate issued by <br />the State of Ohio in a form under seal or a copy thereof. No further or additional testing, review <br />or evidence of skill shall be required of a contractor demonstrating such compliance with said <br />state law, provided however, that the evidence of compliance is also submitted as required in <br />subparagraph (e) herein. <br />(d) License Submittals. All applicants for a local license must provide satisfactory <br />
