Account number or other evidence of registration and/or certification of <br />compliance with RITA withholding. <br />(5) A certificate of compliance with Renovation, Repair and Painting <br />(RRP) Rules issued by the Environmental Protection Agency (EPA) <br />for lead-based paint and/or window replacement, where applicable. <br />(f) Issuance of Certificate. The Building Commissioner, upon receipt of all required <br />fees, documentation and evidence of compliance necessary to satisfy the provisions herein, shall <br />issue or deny a certificate of registration for a state licensed contractor pursuant to subsections <br />(c) and (e); shall issue or deny a local license certificate pursuant to subsection (d) and (e) ; or <br />shall issue or deny both forms of certification to qualified applicants. An application shall not be <br />deemed to have been approved until the Building Commissioner has examined such application, <br />determined therefrom that the applicant has satisfied the requirements of Section 1317.04, and <br />has issued a certificate for local license or a certificate for registration of state licensee or both. <br />(g) Appeals. The applicant for a local license or registration certificate may appeal <br />from the denial by the Building Commissioner to the Board of Building Code Appeals. The <br />Board shall hear and decide the appeal at its next regular meeting. At the discretion of the Board <br />of Building Code Appeals, after a review of records and an oral examination, a temporary local <br />license certificate may be issued but not to exceed two years in duration. After the two-year <br />probationary period, the applicant may reapply to the Building Commissioner and, upon appeal, <br />the Board shall either deny or affirm the application. An applicant for a local license certificate <br />or a probationary local licensee may obtain a state license or certification and also apply for <br />registration thereof under subparagraph (c), which registration shall be independent of the local <br />license requirement with respect to the work or trade so licensed by the State. <br />(h) Records. The Building Commissioner shall keep a record of all certificates of <br />registration and certificates for local licenses, and together with other documentation forming the <br />basis for the issuance, or the denial thereof, on file for not less than three years. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is necessary that this legislation go into effect immediately because the <br />Environmental Protection Agency has enacted Renovation, Repair and Painting (RRP) Rules <br />which go into effect April 22, 2010, with respect to lead-based paint certification; and further <br />provided that it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ~(l !^ I ~i ~l t7 <br />ATT T: <br />MARIE GALLO <br />Clerk of Council <br />First Reading: l,~~o~ ~~o ( ~ <br />Second Reading: ~,0/yd/~ <br />Third Reading: .~~,~ <br />Committee: <br />r-- <br />..--~ ~ <br />DUANE K.
