CITY OF NORTH OLMSTED RESOLUTION N0.2010 - 57 By: The Mayor and Entire City Council A RESOLUTION RECORDING OBJECTION TO THE ISSUANCE OF LIQUOR PERMIT NO. 3061538 TO GARY VON AGENCY, INC., DBA "GLITZ" FOR NIGHTCLUB FORMERLY LOCATED AT 25700 LORAIN ROAD, NORTH OLMSTED, OHIO, AND DECLARINGANEMERGENCY. WHEREAS, this Council received notice from the Ohio Division of Liquor Control dated April 23, 2010 for the proposed issuance of liquor permit number 3061538 to Gary Von Agency, Inc., dba "Glitz" for a nightclub at 25700 Lorain Road, North Olmsted, Ohio; and WHEREAS, upon information and belief the former "Glitz" nightclub building previously was demolished and the land area subsequently developed in connection with the Ganley Volkswagon dealership and there is no longer a suitable building corresponding with the liquor permit premises of 25700 Lorain Road, North Olmsted, Ohio; and WHEREAS, according to information and documentation provided by the North Olmsted Department of Public Safety to this Council, there is no structure whatsoever located at 25700 Lorain Road, much less a building suitable for and in compliance with law for use as a nightclub; and WHEREAS, this Council believes, based upon the information provided to it by the North Olmsted Division of Building, that the proposed liquor permit premises at 25700 Lorain Road cannot be operated as a liquor permit premises in compliance with laws, regulations, or local ordinances (ORC Section 4303.292(A)(1)(b)); and WHEREAS, this Council further believes, based upon the information provided to it by the North Olmsted Department of Law, that the place at 25700 Lorain Road at which the said liquor permit is held, is so located with respect to the neighborhood that substantial interference with public decency, sobriety, peace, or good order would result from the transfer of ownership of the permit and operations under it by the applicant (ORC Section 4303.292(A)(2)(c)); and WHEREAS, Gary Von Agency, Incorporated no longer exists as an Ohio Corporation, as the records of the Ohio Secretary of State demonstrate that it was cancelled by the State of Ohio Tax Department on December 29, 1995; and WHEREAS, based upon the foregoing and the recommendation of the North Olmsted Division of Police, this Council believes it is in the best interests of the public health, safety and welfare of the North Olmsted community to object to the said transfer of ownership of the liquor permit at 25700 Lorain Road and request a hearing before the Division of Liquor Control, in accordance with the provisions of ORC Section 4303.26, on the advisability of said transfer of ownership of liquor permit.
