CITY OF NORTH OLMSTED ORDINANCE N0.2010-66 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 139 OF THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF PUBLIC SAFETY" IN ORDER TO PROVIDE FOR THE RE- ORGANIZATION THEREOF, AND DECLARING AN EMERGENCY. WHEREAS, on May 4, 2010, the electors of the City of North Olmsted approved Issue 34 to amend the Charter of the City of North Olmsted, whereby all departments and divisions there under, with the exception of the Department of Law and the Department of Finance, are to be established by the Council via ordinance; and WHEREAS, the Administration has analyzed the operations and structure of the departments and divisions of the City and has determined that efficiency in operation and cost savings can be achieved through the re-organization of the various departments and divisions; and WHEREAS, it is the recommendation of the Administration that the Department of Public Safety, upon approval of this Ordinance, consist of a Director of Public Safety, a Division of Police and a Division of Fire, and support staff; and WHEREAS, consistent with the recommendation of the Mayor, it is the desire of this Council to reorganize the Department of Public Safety by amending Chapter 139 of the Administrative Code. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Department of Public Safety established via ordinances 65-241, 77-85, 94-62, 95-68, 2002-166 and 2006-84 (collectively known as Chapter 139 Department of Public Safety) shall be and remain in effect until July 31, 2010. As of August 1, 2010 the Department of Public Safety, as amended herein, shall be in effect. SECTION 2: That Chapter 139 "Department of Public Safety," which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended effective August 1, 2010, and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. SECTION 3 That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re-codification.
