CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010-66 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 139 <br />OF THE ADMINISTRATIVE CODE ENTITLED "DEPARTMENT OF <br />PUBLIC SAFETY" IN ORDER TO PROVIDE FOR THE RE- <br />ORGANIZATION THEREOF, AND DECLARING AN EMERGENCY. <br />WHEREAS, on May 4, 2010, the electors of the City of North Olmsted approved Issue <br />34 to amend the Charter of the City of North Olmsted, whereby all departments and divisions <br />there under, with the exception of the Department of Law and the Department of Finance, are to <br />be established by the Council via ordinance; and <br />WHEREAS, the Administration has analyzed the operations and structure of the <br />departments and divisions of the City and has determined that efficiency in operation and cost <br />savings can be achieved through the re-organization of the various departments and divisions; <br />and <br />WHEREAS, it is the recommendation of the Administration that the Department of <br />Public Safety, upon approval of this Ordinance, consist of a Director of Public Safety, a Division <br />of Police and a Division of Fire, and support staff; and <br />WHEREAS, consistent with the recommendation of the Mayor, it is the desire of this <br />Council to reorganize the Department of Public Safety by amending Chapter 139 of the <br />Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Department of Public Safety established via ordinances 65-241, <br />77-85, 94-62, 95-68, 2002-166 and 2006-84 (collectively known as Chapter 139 Department of <br />Public Safety) shall be and remain in effect until July 31, 2010. As of August 1, 2010 the <br />Department of Public Safety, as amended herein, shall be in effect. <br />SECTION 2: That Chapter 139 "Department of Public Safety," which presently reads in <br />its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein, shall be amended effective August 1, 2010, and, as <br />amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this <br />Ordinance and likewise incorporated by reference as if fully rewritten herein. <br />SECTION 3 That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />
