CITY OF NORTH OLMSTED RESOLUTION N0.2010 - 67 BY: Mayor Kennedy A RESOLUTION EXTENDING THE CITY'S CONTRACT WITH RICHARD L. BOWEN + ASSOCIATES, INC., TO PROVIDE CONSULTING AND ENGINEERING SERVICES, INCLUDING PROVISION OF A CITY ENGINEER AND ASSISTANT CITY ENGINEER; AND DECLARING AN EMERGENCY. WHEREAS, this Council adopted Ordinance Number 2008-165 authorizing the Director of Public Service to request qualifications for consulting and engineering services (RFQ's), including the provision of a City Engineer, Assistant Engineer; and WHEREAS, on May 28, 2009, pursuant to said RFQ process, the Director of Public Service recommended and the Board of Control approved a contract with Richard L. Bowen + Associates Inc., as the engineering firm most capable to perform the consulting and engineering services required, including the provision of personnel, and at the most reasonable price; and WHEREAS, on June 1, 2009, the City entered into aone-year contract with Richard L. Bowen + Associates, Inc. to provide engineering consulting services to the City, including personnel to serve as City Engineer and Assistant Engineer; and WHEREAS, it is the desire of this Council to authorize an extension of the City's contract with Richard L. Bowen + Associates through December 31, 2010, to afford the Administration additional time to consider options for engineering services and to prevent any disruption in required City engineering services; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a contract extension with Richard L. Bowen + Associates, Inc., to act as the City's consulting engineer, including provision of services and personnel as the City Engineer and Assistant City Engineer, extending the current contract for an additional seven month period until December 31, 2010. Any such contract extension shall be in form and substance consistent with the current contract between the City and Richard L. Bowen + Associates, Inc., a copy of which is attached hereto, with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare, of this City and for the further reason that this Resolution is required to be immediately effective because of vital City construction projects underway that require continuity of engineering services by the current City Engineer; and further provided it receives the affirmative vote of two- thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
