CITY OF NORTH OLMSTED <br />RESOLUTION N0.2010 - 67 <br />BY: Mayor Kennedy <br />A RESOLUTION EXTENDING THE CITY'S CONTRACT WITH RICHARD <br />L. BOWEN + ASSOCIATES, INC., TO PROVIDE CONSULTING AND <br />ENGINEERING SERVICES, INCLUDING PROVISION OF A CITY <br />ENGINEER AND ASSISTANT CITY ENGINEER; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council adopted Ordinance Number 2008-165 authorizing the Director <br />of Public Service to request qualifications for consulting and engineering services (RFQ's), <br />including the provision of a City Engineer, Assistant Engineer; and <br />WHEREAS, on May 28, 2009, pursuant to said RFQ process, the Director of Public <br />Service recommended and the Board of Control approved a contract with Richard L. Bowen + <br />Associates Inc., as the engineering firm most capable to perform the consulting and engineering <br />services required, including the provision of personnel, and at the most reasonable price; and <br />WHEREAS, on June 1, 2009, the City entered into aone-year contract with Richard L. <br />Bowen + Associates, Inc. to provide engineering consulting services to the City, including <br />personnel to serve as City Engineer and Assistant Engineer; and <br />WHEREAS, it is the desire of this Council to authorize an extension of the City's <br />contract with Richard L. Bowen + Associates through December 31, 2010, to afford the <br />Administration additional time to consider options for engineering services and to prevent any <br />disruption in required City engineering services; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a contract <br />extension with Richard L. Bowen + Associates, Inc., to act as the City's consulting engineer, <br />including provision of services and personnel as the City Engineer and Assistant City Engineer, <br />extending the current contract for an additional seven month period until December 31, 2010. <br />Any such contract extension shall be in form and substance consistent with the current contract <br />between the City and Richard L. Bowen + Associates, Inc., a copy of which is attached hereto, <br />with only such changes therein as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the agreement by the <br />Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of this <br />City and for the further reason that this Resolution is required to be immediately effective <br />because of vital City construction projects underway that require continuity of engineering <br />services by the current City Engineer; and further provided it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />
