CITY OF NORTH OLMSTED RESOLUTION N0.2010 - 76 BY: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF THE CITY OF NORTH OLMSTED, TO ENTER INTO AN AGREEMENT WITH THE AMERICAN CANCER SOCIETY (RELAY FOR LIFE), GRANTING THE LATTER PERMISSION TO PLACE PROMOTIONAL MATERIALS FOR THE RELAY FOR LIFE EVENT ON POLES LOCATED IN THE CITY RIGHT-OF-WAY, AND DECLARING AN EMERGENCY. WHEREAS, it is the desire of the American Cancer Society to place ribbons /bows on designated Cleveland Electric Illuminating Company ("CEI") poles located on Lorain Road and Butternut Ridge Road in order to promote the Relay for Life on June 19, 2010 through June 20, 2010; and WHEREAS, the Mayor and the Directors of Public Safety and Planning support this project; and WHEREAS, it is the desire therefore of this Council to accordingly authorize the Mayor to enter into an Agreement with the American Cancer Society granting it permission to place ribbons /bows on CEI poles in the right-of--way at streets to be designated in the Agreement and to provide for the City's participation in the said project; NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he is hereby authorized to enter into an agreement with the American Cancer Society permitting the latter to place ribbons /bows on designated CEI poles located in the City right-of--way and providing for the City's participation in the project. Said agreement shall be substantially in the form as the Agreement attached hereto as Exhibit A, with only such changes therein as are not substantially adverse to the City and which are approved by the Mayor and the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
