CITY OF NORTH OLMSTED <br />RESOLUTION N0.2010 - 76 <br />BY: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF THE <br />CITY OF NORTH OLMSTED, TO ENTER INTO AN AGREEMENT WITH <br />THE AMERICAN CANCER SOCIETY (RELAY FOR LIFE), GRANTING <br />THE LATTER PERMISSION TO PLACE PROMOTIONAL MATERIALS <br />FOR THE RELAY FOR LIFE EVENT ON POLES LOCATED IN THE CITY <br />RIGHT-OF-WAY, AND DECLARING AN EMERGENCY. <br />WHEREAS, it is the desire of the American Cancer Society to place ribbons /bows on <br />designated Cleveland Electric Illuminating Company ("CEI") poles located on Lorain Road and <br />Butternut Ridge Road in order to promote the Relay for Life on June 19, 2010 through June 20, <br />2010; and <br />WHEREAS, the Mayor and the Directors of Public Safety and Planning support this <br />project; and <br />WHEREAS, it is the desire therefore of this Council to accordingly authorize the Mayor <br />to enter into an Agreement with the American Cancer Society granting it permission to place <br />ribbons /bows on CEI poles in the right-of--way at streets to be designated in the Agreement and <br />to provide for the City's participation in the said project; <br />NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he is <br />hereby authorized to enter into an agreement with the American Cancer Society permitting the <br />latter to place ribbons /bows on designated CEI poles located in the City right-of--way and <br />providing for the City's participation in the project. Said agreement shall be substantially in the <br />form as the Agreement attached hereto as Exhibit A, with only such changes therein as are not <br />substantially adverse to the City and which are approved by the Mayor and the Director of Law. <br />The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval of the <br />agreement by the Director of Law. <br />
