CITY OF NORTH OLMSTED ORDINANCE N0.2010 - 83 BY: Mayor Kennedy AN ORDINANCE PROVIDING FOR THE SUBMISSION OFAN AMENDMENT TO THE ELECTORS OF THE CITYOFNORTH OLMSTED TO ARTICLE III, SECTION 2 OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO CLARIFY RESTRICTIONS ON OTHER EMPLOYMENT AND HOLDING OTHER PUBLIC OFFICE BY THE MAYOR, AND DECLARING AN EMERGENCY. WHEREAS, the City Charter currently restricts the Mayor from holding "any other public office or public employment"; and WHEREAS, from time to time Mayors are nominated and requested to serve on regional boards and commissions including, but not limited to, the Greater Cleveland Regional Transit Authority Board; and WHEREAS, the Mayor's presence and membership on regional boards and commissions gives a stronger voice to the residents of the City of North Olmsted in matters both regional and local; and WHEREAS, the Mayor is currently restricted from participating in membership on some regional boards and commissions because membership includes compensation, thereby rendering the membership "public employment"; and WHEREAS, the restriction on holding any other public office or public employment should be limited to holding public office or public employment within the City of North Olmsted; and WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article III, Section 2 of the Charter of the City of North Olmsted so as to clarifying restrictions on other employment by the Mayor, and WHEREAS, this proposal was reviewed and recommended by the Charter Review Commis ' on in acc rdance with Article XIV, Section (b)(1) of the City Charter, and the Commission on the day of I~ ,t ~~, , 2010, filed a written report with the Clerk of Council in which the Commission stated that, by a ~ to (7 vote, a motion to recommend approval of the proposal (passed failed); and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner
