CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 83 <br />BY: Mayor Kennedy <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION OFAN <br />AMENDMENT TO THE ELECTORS OF THE CITYOFNORTH <br />OLMSTED TO ARTICLE III, SECTION 2 OF THE CHARTER <br />OF THE CITY OF NORTH OLMSTED TO CLARIFY <br />RESTRICTIONS ON OTHER EMPLOYMENT AND HOLDING <br />OTHER PUBLIC OFFICE BY THE MAYOR, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the City Charter currently restricts the Mayor from holding "any other public <br />office or public employment"; and <br />WHEREAS, from time to time Mayors are nominated and requested to serve on regional <br />boards and commissions including, but not limited to, the Greater Cleveland Regional Transit <br />Authority Board; and <br />WHEREAS, the Mayor's presence and membership on regional boards and commissions <br />gives a stronger voice to the residents of the City of North Olmsted in matters both regional and <br />local; and <br />WHEREAS, the Mayor is currently restricted from participating in membership on some <br />regional boards and commissions because membership includes compensation, thereby rendering the <br />membership "public employment"; and <br />WHEREAS, the restriction on holding any other public office or public employment should <br />be limited to holding public office or public employment within the City of North Olmsted; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article III, Section 2 of the Charter of the City of North Olmsted so as to <br />clarifying restrictions on other employment by the Mayor, and <br />WHEREAS, this proposal was reviewed and recommended by the Charter Review <br />Commis ' on in acc rdance with Article XIV, Section (b)(1) of the City Charter, and the Commission <br />on the day of I~ ,t ~~, , 2010, filed a written report with the Clerk of Council in which the <br />Commission stated that, by a ~ to (7 vote, a motion to recommend approval of the proposal <br />(passed failed); and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />
