That Article IV, Section 3 of the Charter of the City of North Olmsted be amended to permit <br />the President of Council to recommend and introduce legislation and to participate in the discussion <br />of all matters coming before Council, as follows: <br />ARTICLE IV THE COUNCIL <br />SEC. 3. PRESIDENT OF COUNCIL <br />(a) Separate Office. The President of Council shall be elected by the voters. <br />Candidates for such office shall file specifically for the office in accordance with the <br />provisions of the Charter. <br />(b) Duties. The President of Council shall preside at all regular and special <br />meetings of Council, but he shall have no vote therein except in the event of a tie. The <br />President of Council shall have the right to recommend and introduce legislation and <br />to take part in the discussion of all matters coming before Council. He shall perform <br />such duties as presiding officer as may be imposed upon him by Council. <br />(c) Acting Mayor. In the absence of the Mayor, the President of Council shall act <br />as Mayor as provided in Article III of this Charter. <br />(d) Vacancy in Office. Whenever the office of President of Council becomes <br />vacant, the vacancy shall be filled by appointment by majority vote of the members of <br />Council eligible to vote, to serve for the unexpired term or until the election of a successor <br />for the unexpired term at the next regular municipal election provided that (a) such election <br />shall occur more than two years prior to the expiration of the unexpired term and (b) the <br />vacancy shall have occurred not less than thirty (30) days prior to the candidate filing <br />deadline for said next regular municipal election. If Council fails to fill said vacancy within <br />thirty (30) days, the Mayor shall appoint a President of Council to fill said vacancy. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article IV, Section 3 of the Charter shall be <br />effective upon certification of such affirmative vote following the election on November 2, 2010. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article IV, Section 3 of the Charter of the City of North <br />Olmsted be amended to permit the President of Council to <br />2 <br />
