CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 85 <br />BY: Mayor Kennedy <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION OFAN <br />AMENDMENT TO THE ELECTORS OF THE CITYOFNORTH <br />OLMSTED TO ARTICLE IX, SECTION 3 OF THE CHARTER <br />OF THE CITY OF NORTH OLMSTED TO CHANGE THE <br />PRIMARY ELECTION TO THE SECOND -T TUESDAY <br />A IiTL'A Tr~~ z'r~ 7' ~,rn~m ~ v jN SEPTEMBER, AND <br />DECLARING AN EMER GENCY, AS AMENDED . <br />WHEREAS, the Cuyahoga County Board of Elections is desirous of coordinating election <br />dates throughout the County so that all municipal primary elections occur in either May or <br />September; and <br />WHEREAS, a September primary date shortens and condenses what is otherwise a lengthy <br />election season; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article IX, Section 3 of the Charter of the City of North Olmsted so as to change <br />the primary election date to the first Tuesday after the first Monday in September when a primary is <br />otherwise required to be held; and <br />WHEREAS, this proposal was reviewed and recommended by the Charter Review <br />Commissi n in accordance with Article XIV, Section (b)(1) ofthe City Charter, and the Commission <br />on the q~ay of Ju,~ , 2010, filed a written report with the Clerk of Council in which the <br />Commission stated that, by a '1 to t7 vote, a motion to recommend approval of the proposal <br />(passed)(failed); and <br />~= <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be <br />voted upon by the electorate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OFALL MEMBERS <br />CONCURRING THAT: <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />
