CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 88 <br />BY: Mayor Kennedy <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION OFAN <br />AMENDMENT TO THE ELECTORS OF THE CITYOFNORTH <br />OLMSTED TOARTICLE V, SECTION2 OF THE CHARTER OF <br />THE CITY OF NORTH OLMSTED TO REQUIRE THE <br />DIRECTOR OF LAW TO PERFORM ALL OTHER DUTIES <br />NOW OR HEREINAFTER IMPOSED BY COUNCIL OR THE <br />MAYOR CONSISTENT WITH THE D UTIES OF THE OFFICE <br />OFDIRECTOR OFLAW,ANDDECLARINGANEMERGENCY. <br />WHEREAS, the City Charter currently requires the Director of Law to perform duties <br />imposed upon the city solicitors as established by the laws of the State of Ohio; and <br />WHEREAS, as a Charter community, the City of North Olmsted has seen it appropriate to <br />when possible proscribe the duties of the Director of Law in its Charter and ordinances as opposed to <br />relying upon the statutes of the State of Ohio; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article V, Section 2 of the Charter of the City of North Olmsted so as to clarify <br />that the duties of the Director of Law, when possible, shall be imposed by the Council and Mayoras <br />opposed to state statutes generally governing city solicitors; and <br />WHEREAS, this proposal was reviewed and recommended by the Charter Review <br />Commission in accordance with Article XIV, Section (b)(1) ofthe City Charter, and the Commission <br />on the day of ~~, 2010, filed a written report with the Clerk of Council in which the <br />Commission stated that, by a ~ to D vote, a motion to recommend approval of the proposal <br />(passed)(failed); and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be <br />voted upon by the electorate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OFALL MEMBERS <br />CONCURRING THAT: <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at an election to be held at the usual places of voting in the City on Tuesday, <br />
