(c) To review, upon motion of any member of the Board, any rule, regulation or <br />decision of the Board, but no such review shall prejudice the rights of any person who has in <br />good faith acted thereon before it is reversed or modified. <br />To exercise with respect to buildings situated in the City the same powers as are exercised by <br />the Board of Building Standards under the laws of the State of Ohio to the extent that it is <br />competent for this Charter so to authorize the Board. <br />To formulate and submit to the City Council, proposed changes in and amendments to the <br />Building Code, which the Board determines to be desirable for the proper regulation of all <br />buildings and structures and the equipment therein and appurtenances thereto, in the City. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VII, Section 1 of the Charter shall be <br />effective upon certification of such affirmative vote following the election on November 2, 2010. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VII, Section 1 of the Charter of the City of North <br />Olmsted be amended to require members of the Board of Building <br />Code Appeals to be residents and electors of the City of North <br />Olmsted who do not hold other municipal office in the City of North <br />Olmsted and who possess particular knowledge of standardized state <br />and city building codes? <br />Yes <br />No <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 2, 2010, and no <br />later than September 3, 2010. <br />3 <br />
