committed child-victim oriented offenses and for community notification regarding sexual <br />predators, child-victim predators, habitual sex offenders, and habitual child-victim offenders who <br />are about to be or have been released from imprisonment, a prison term, or other confinement or <br />detention and who will live in or near a particular neighborhood or who otherwise will live in or <br />near a particular neighborhood, it is the general assembly 's intent to protect the safety and <br />general welfare of the people of this state;" and <br />WHEREAS, this Council specifically re-adopts and re-states said findings, declarations, <br />and purpose of the Ohio General Assembly in establishing the State's registration requirements <br />for certain classes of convicted sex offenders; and <br />WHEREAS, it is the desire of this Council, in a lawful exercise of the home rule powers <br />of the City of North Olmsted, to establish a local regulation regarding the number of sex <br />offenders occupying a single dwelling unit within One and Two Family Residence Districts <br />(Chapter 1135), Multiple Residence (Apartment) District (Chapter 1137), Senior Residence <br />District (1138), and Residential Cluster (RC) District, in order to further the health, safety of <br />welfare of North Olmsted residents, and in particular children living in the North Olmsted <br />community; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 533.16 of the North Olmsted Codified Ordinances, entitled <br />"Registered Offenders -Local Regulations," which currently reads as follows: <br />533.16 REGISTERED OFFENDERS -LOCAL REGULATIONS. <br />(a) As used in this section: <br />(1) "Childcare Facility" means any preschool, daycare or other facility for the <br />care of children that is licensed by the State of Ohio. <br />(2) "Park or Recreation Facility" mean any land and/or building owned or <br />controlled by the City of North Olmsted and used for park or recreation purposes, <br />including, but not limited to, the Recreation Center, Clague Park, North Olmsted <br />Park, and Barton-Bradley Soccer Field. <br />(3) "Public Body" has the same meaning as found in Section 121.22 of the Ohio <br />Revised Code. <br />(4) "Registered Offender" means any person who is required to register with a <br />County Sheriff pursuant to any of the provisions of Ohio Revised Code Chapter <br />2950, including, but not limited to, Sections 2950.04, 2950.041, or 2950.05. <br />(b) No registered offender shall establish a residence or occupy residential premises <br />within Two Thousand Feet (2000 ft) of any property line of any real property located in <br />
