.. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2010 - 101 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A <br />FIRST AMENDMENT TO LICENSING A GREEMENT WITH THE <br />NORTH OLMSTED COMMUNITY COUNCIL, INC., AUTHORIZING <br />PLACEMENT OF "HOMECOMING" BANNERS ON POLES <br />LOCATED IN THE CITYRIGHT-OF-Wfl YAT THE INTERSECTION <br />OF CLAGUE AND LORAIN ROADS AND THE INTERSECTION OF <br />STEARNS AND LORAIN ROADS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council adopted Resolution 2009-74 authoring the Mayor to <br />enter into a Licensing Agreement with the North Olmsted Community Council, Inc. <br />[hereinafter, the "Community Council"] to place four (4) banners on designated <br />Cleveland Electric Illuminating Company ("CEI") poles located on Lorain Road near <br />North Olmsted Park in order to promote the annual Homecoming Event; <br />WHEREAS, the Community Council now proposes to increase the number of <br />promotional banners for "Homecoming" and requests permission to place four (4) <br />additional banners in the right of way at the intersections of Clague and Lorain and <br />Stearns and Lorain, for a total of eight (8) additional banners and twelve (12) overall; and <br />WHEREAS, the Mayor and the Directors of Public Service and Pianning support <br />this Community Council project; and <br />WHEREAS, it is the desire therefore of this Council to accordingly authorize the <br />Mayor to enter into a First Amendment to the Licensing Agreement with the Community <br />Council granting it permission to place Homecoming banners on CEI poles in the right- <br />of-way; <br />NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION L• That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into a First Amendment to Licensing Agreement with the <br />North Olmsted Community Council, Inc. permitting the latter to place Homecoming <br />banners. Said agreement shall be substantially in the form as the Agreement attached <br />hereto as Exhibit A, with only such changes therein as are not substantially adverse to the <br />City and which are approved by the Mayor and the Director of Law. The character of any <br />such changes as not being substantially adverse to the City shall be evidenced
