CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2010 - 105 <br />By: Mayor Kennedy & Council Member Barker <br />AN ORDINANCE AMENDING CHAPTER 177 OF THE <br />ADMINISTRATIVE CODE ENTITLED "COMMUNITY ACCESS," <br />IN ORDER TO ESTABLISH NONPUBLIC FORUMS PERMITTING <br />COMMUNITY ORGANIZATIONS TO ACCESS CITY DISPLAY <br />CASES AND PUBLIC LAWN AREAS FOR THE PURPOSE OF <br />POSITIVELY PROMOTING THE WELFARE AND DEVELOPMENT <br />OF NORTH OLMSTED, AND FURTHER ENACTING PROVISIONS <br />FOR REGULATING THE NONPUBLIC FORUMS, AS AMENDED. <br />WHEREAS, the City of North Olmsted operates several display cases in the <br />lobbies of public buildings and owns lawn areas on public property near the public right <br />of way; and <br />WHEREAS, it is the desire of this Council to establish these display cases and <br />lawn areas as "City media" and establish regulations governing access to these media by <br />community organizations; and <br />WHEREAS, it is the intention of the Council in providing access to these media <br />to create nonpublic forums; and <br />WHEREAS, it is the desire of this Council to act consistently with the First <br />Amendment to the United States Constitution; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 177 of the Administrative Code, entitled "Community <br />Access," which currently reads as follows: <br />177.01 DEFINITIONS. <br />(a) "City media", unless otherwise specified, means any of the following: <br />(1) The airspace located approximately 20-25 feet above Lorain Road <br />approximately mid-way between East Park and West Park Drives, <br />and in the vicinity of a certain CEI wire, or wires, which traverse <br />that airspace above Lorain Road from north to south;
