(g) No banner shall be permitted to be erected more than two weeks prior to
the date of the single event announced, or more than two weeks prior to
the date of the first event of a recurring event announced; the City shall
remove the banner and return it to the applicant within three (3) days
following the date of the occurrence of the single event announced or
within three (3) days following the date of the first event of a recurring
event.
177.07 PRIORITY IN CASES OF CONFLICT; TIME LIMITS.
The following provisions pertain solely to the airspace as described in Section
177.01(a)(1) and the changeable copy signs as described in Section 177.01(a)(2) and (3):
(a) Applications for single event announcements shall not be accepted if the
event announced occurs more than one (1) year after the time of
submission of the application.
(b) In cases where multiple applications have been received for simultaneous
posting of proposed announcements, the following order of priority shall
apply: the first application filed with the City shall have priority over all
subsequently filed applications.
177.08 APPEALS FROM DECISIONS OF MAYOR'S DESIGNEE.
(a) Every decision of the Mayor's designee denying an application to
announce a community event, or denying an organization's request to link
to the City's website, may be appealed to a Community Access Board
consisting of the Mayor, the Director of Public Safety, and the Director of
Human Resources. Any such appeal must be in writing and filed with the
Mayor's designee within seven (7) workdays following the date of the
mailing of the decision denying the application.
(b) The Community Access Board shall hear the appeal of the applicant, shall
permit the applicant to offer evidence in support of its application, and
shall render its decision no later than ten (10) work days following the
date upon which the appeal was filed. No decision shall be made by the
Community Access Board until it has first consulted with the City
Director of Law. In reviewing appeals made, the Community Access
Board shall uphold the decision of the Mayor's designee only if the Board
concludes that either the application or the proposed announcement
violates at least one provision of this chapter. Every decision of the
Community Access Board shall be considered a final administrative order,
subject to further appeal pursuant to the provisions of Chapter 2506 of the
Ohio Revised Code.
177.09 NON-ENDORSEMENT POLICY OF CITY.
A decision to allow a community organization to announce an event, or to allow a
link to the City's website, should not be construed as an implied endorsement by the City
of the aims, goals, or activities of the organization represented; nor should such decision
be construed as implying a preference for that organization over other organizations of
the same type. Furthermore, the absence of an announcement or link by an organization
of a type otherwise represented should not be construed, by itself, as evidence of a denial
of access to that organization.
