CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2010 - 161 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO MAKE APPLICA TION <br />FOR A WATER POLLUTION CONTROL LOAN FUND AGREEMENT ON <br />BEHALF OF THE CITY OF NORTH OLMSTED FOR PLANNING, <br />DESIGN, AND / OR CONSTRUCTION OF WASTE WATER FACILITIES; <br />AND FUR THER A UTHORIZING THE MA YOR TO ENTER INTO THE <br />AGREEMENT IF THE APPLICATION IS ACCEPTED; AND FURTHER <br />DESIGNATING A DEDICATED REPAYMENT SOURCE FOR THE LOAN, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted seeks to upgrade its existing wastewater and <br />collection facilities; and <br />WHEREAS, the City of North Olmsted desires to apply for Water Pollution Control <br />Loan Funds (WPCLF) for the planning, design, and / or construction of the wastewater facilities; <br />and <br />WHEREAS, the Ohio Water Pollution Control Loan Fund requires the City of North <br />Olmsted to enact legislation for application of the loan, the execution of an agreement and <br />dedication of a dedicated repayment source. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to apply for a WPCLF <br />loan; and does further authorize the Mayor to execute a contract and any and all other papers <br />necessarily required by the WPCLF including, but not limited to, a Water Pollution Control Loan <br />Fund agreement with the Ohio Environmental Protection Agency and the Ohio Water <br />Development Authority for the planning, design and / or construction of wastewater facilities on <br />behalf of the City of North Olmsted. <br />SECTION 2: That the dedicated source of repayment be, and the same is hereby <br />desibnated, the "User Revenue Account." <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may make a timely application with the State of Ohio for participation; and further, provided it <br />receives the affirmative vote of two-thirds of all members of the Council, it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTEST: <br />First Reading: ?.?/f}vl 0 <br />Second Reading: <br />Third Reading: 1 ; ^ `97 <br />Committee: f L,?r ,^ <br />''1
