.... .. ........ .. .I~.w-I.au..n.~ ~... _..,. n.s..»m+wa.ww.v+..... .r~m+.r+w.awt~+vw.wr.-.wie..w..w~,-e.w+.~....~.vaancw.e++vw..e.r+ro+n <br />Director of Finance pursuant thereto, authorizing the issuance and sale of <br />the Original Bonds. <br />"Original Bonds" means the City's $1,540,000 Street Improvement <br />Bonds, Series 2001, issued as a part of a consolidated issue of $12,430,000 <br />Capital Improvement and Refunding Bonds, Series 2001, dated as of May <br />1, 2001, pursuant to the Original Bond Legislation. <br />"Original Purchaser" means NatCity Investments, Inc., Cleveland, <br />Ohio. <br />"Participant" means any participant contracting with a Depository <br />under a book entry system and includes securities brokers and dealers, <br />banks and trust companies, and clearing corporations. <br />"Principal Payment Dates" means December 1 in each of the years <br />from 2006 through 2016; provided that the first Principal Payment Date <br />may be deferred for a period not longer than two years if that deferral is <br />determined by the Mayor and Director of Finance to be in the best interest <br />of and financially advantageous to the City and that determination is set <br />forth in the Certificate of Award. <br />"Purchase Agreement" means the Bond Purchase Agreement <br />between the City and the Original Purchaser, as it may be modified from the <br />form on file with the Clerk of Council and signed by the Mayor and the <br />Director of Finance in accordance with Section 6. <br />"Refunded Bonds" means the $1,410,000 of the Original Bonds now <br />outstanding stated to mature on December 1 in the years from 2013 through <br />2016. <br />"Registrar Agreement" means the Bond Registrar Agreement <br />between the City and the Bond Registrar, as it may be modified from the <br />form on file with the Clerk of Council and signed by the Mayor and the <br />Director of Finance in accordance with Section 4. <br />"Rule" means Rule 15c2-12 prescribed by the SEC pursuant to the <br />Securities Exchange Act of 1934. <br />"SEC" means the Securities and Exchange Commission. <br />The captions and headings in this ordinance are solely for <br />convenience of reference and in no way define, limit or describe the scope <br />or intent of any Sections, subsections, paragraphs, subparagraphs or clauses <br />hereof. Reference to a Section means a section of this ordinance unless <br />otherwise indicated." <br />Section 2. Section 3 of Ordinance No. 2006-31 passed on February 21, 2006, be and is <br />hereby amended to read as follows: <br />"Section 3. Denominations; Datin ;Principal and Interest Payment <br />and Redemption Provisions. The Bonds shall be issued in one lot and only <br />as fully registered bonds, in the Authorized Denominations, but in no case <br />as to a particular maturity date exceeding the principal amount maturing on <br />-4- <br />
