<br />AN ORDINANCE AMENDING, DELETING, AND CREATING
<br />NEW SECTIONS IN CHAPTERS 1301, 1303, 1305, 1307 AND
<br />1309 OF THE NORTH OLMSTED BUILDING CODE FOR THE
<br />PURPOSE OF ADOPTING THE 2004 RESIDENTIAL CODE
<br />OF OHIO FOR ONE-, TWO-, AND THREE-FAMILY
<br />DWELLINGS, AND TO ELIMINATE CONFLICTS BETWEEN
<br />THE NEW STATE CODE AND THE CITY'S LOCAL
<br />BUILDING CODE.
<br />WHEREAS, this Council has previously adopted the provisions of the Ohio Building
<br />Officials Association (OBOA) One, Two and Three Family Dwellings Code, 1999 edition, and
<br />incorporated same into Chapter 1305 of the Codified Ordinances of the City of North Olmsted;
<br />and
<br />WHEREAS, upon the recommendation of the Building Commissioner, with the
<br />concurrence of the Director of Law, this Council is hereby advised that the City should adopt the
<br />2004 Residential Code of Ohio for One-, Two-, and Three-Family Dwellings, which is a state-
<br />mandated Code that will be effective in the State of Ohio on May 27, 2006, and make certain
<br />other changes in Chapters 1301, 1303, 1305, 1307, and 1309 of the North Olmsted Building Code
<br />in order to eliminate any conflicts between the State Code and the City's local building code; and
<br />WHEREAS, it is also the intent and desire of this Council, by its adoption of the said riew
<br />State Code, and by the various other amendments, deletions and creation of new sections within
<br />Chapters 1301, 1303, 1305, 1307, and 1309 of the North Olmsted Building Code, to authorize the
<br />North Olmsted Building Department to enforce uniform standards and safety requirements for the
<br />erection, construction, repair, alteration and maintenance of one-, two-, and three-family
<br />dwellings within the City of North Olmsted;
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION 1: That the City of North Olmsted hereby adopts the 2004 Residential Code of
<br />Ohio for one-, two-, and three-family dwellings.
<br />SECTION 2: That, as expressly set forth in Exhibit A, attached hereto and incorporated
<br />herein by reference as if fully restated herein, and in order to effectuate the adoption of the 2004
<br />Residential Code of Ohio for one-, two-, and three-family dwellings, the following changes in
<br />Chapters 1301, 1303, 1305, 1307, and 1309 of the North Olmsted Building Code are hereby
<br />adopted:
