CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 - 74 <br />BY: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO PURCHASE A COMPLETE 42A WORM/SPUR GEAR <br />ASSEMBLY FROM WALKER PROCESS EQUIPMENT IN THE <br />AMOUNT OF $24,970.00 FOR THE WASTEWATER TREATMENT <br />PLANT, FURTHER A UTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY, TO ENTER INTO A CONTRACT WITH WALKER <br />PROCESS EQUIPMENT FOR THE PURCHASE AND <br />INSTALLATION OF SAID EQUIPMENT, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Director of Public Service has advised this Council that the <br />Wastewater Treatment Plant management has requested authorization to replace a 42A <br />worm/spur gear drive assembly; and <br />WHEREAS, there are no vendors other than Walker Process Equipment who <br />may, without equipment modification, provide this equipment to the City; and <br />WHEREAS, because the total dollar amount of the proposed expenditure is less <br />than $25,000.00, it is not legally required that this expenditure be competitively bid; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Director <br />of Public Service to purchase a 42A worm/spur gear drive assembly from Walker Process <br />Equipment, and further to authorize the Mayor to enter into a contract with Walker <br />Process Equipment providing for the purchase and installation of said equipment ; <br />NOW THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized <br />to purchase a 42A worm/spur gear drive assembly from Walker Process Equipment for <br />use by the Wastewater Treatment Plant, in the total amount of $24,970.00, and further <br />that the Mayor be and he is hereby authorized to enter into a contract with Walker <br />Process Equipment providing for the purchase and installation of said equipment. Said <br />contract shall be in form and substance substantially similar to the proposal from Walker <br />Process Equipment attached hereto as Exhibit A, with only such changes therein as are <br />not substantially adverse to the City and which are approved by the Mayor and the <br />Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced conclusively by the execution of the agreement by the Mayor <br />and the approval of the agreement by the Director of Law. <br />
