CITY OF NORTH OLMSTED ORDINANCE NO. 2006 - 71 BY: Mayor O'Grady AN ORDINANCE CREATING NEW SECTIONS 305.03 THROUGH 305.09 OF CHAPTER 305 OF THE NORTH OLMSTED TRAFFIC CODE, ENTITLED "TRAFFIC CONTROL," IN ORDER TO DELEGATE AUTHORITY TO THE DIRECTOR OF PUBLIC SAFETY TO MAKE TEMPORARY AMENDMENTS TO THE TRAFFIC CONTROL FILE FOR CONSTRUCTION PROJECTS AND DURING EMERGENCIES, AND DECLARING AN EMERGENCY. WHEREAS, Chapter 305 of the North Olmsted Traffic Code, entitled "Traffic Control," currently provides that all amendments to the Traffic Control File must be approved by either motion or ordinance of City Council; and WHEREAS, in order to provide more efficiently and effectively for public safety and the control of traffic during construction projects and emergencies, it is the recommendation of the Mayor that Council delegate authority to the Director of Public Safety to make temporary amendments to the Traffic Control File for construction projects and during emergencies in order to accomplish such goals; and WHEREAS, it is the desire of this Council, acting on the recommendation of the Mayor, to create new Sections 305.03 through 305.09 of Chapter 305 of the North Olmsted Traffic Code, in order to delegate authority to the Director of Public Safety to make temporary amendments to the Traffic Control File for constructions projects and during emergencies; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That there be and hereby are created new Sections 305.03 through 305.09 of Chapter 305 of the North Olmsted Traffic Code, entitled "Traffic Control," which, as created, shall read in their entirety as follows: 305.03 AUTHORITY AND CONSIDERATIONS FOR TEMPORARY PLACEMENT OF DEVICES. The Director of Public Safety is hereby authorized to temporarily amend the traffic control file, and to cause to be placed and maintained traffic control devices upon any street or highway under his jurisdiction as are necessary to effectuate the provisions of this Traffic Code, or to regulate, warn or guide traffic, and such other traffic control devices as he shall deem necessary for the proper control of traffic, for construction projects and during emergencies. The Director of Public Safety shall determine the location, timing and coordination of such traffic control devices upon the basis of an applicable engineering or traffic investigation and shall consider the following:
