Ordinance No. 2006-64 <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Services be and he hereby is authorized <br />to request proposals from consulting engineers and engineering firms to provide <br />professional services for implementation of Phase II of the Sanitary Sewer Plan of Study <br />that was submitted to OEPA, in accordance with the Request for Proposals prepared by <br />the Director of Public Service. A copy of the said Request for Proposals and a sample <br />Professional Services Agreement are attached to this Ordinance as Exhibits A and B. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of <br />the Board of Control, to enter into an agreement or agreements with the engineer or <br />engineering firm selected in the RFP process. Said agreement shall be in the form of the <br />Agreement attached to this Ordinance as Exhibit B, with such additional modifications <br />and changes in form or in substance that are not substantially adverse to the City and <br />which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this legislation be effective immediately it <br />order to meet year 2006 expectations and deadlines set by Ohio EPA; and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ~i 0200(, <br />ATT. <br />;~ <br />BARBARA L.
