Ordinance No. 2006-57 <br />(hl No owner or tenant of anv retail business property shall store anv goods, <br />merchandise, carts, or other personal property, or offer for sale or displavanv goods or <br />merchandise, or permit or suffer ~ulv other person tastore anv goods, merchandise, carts <br />or other personal property. or offer for sale or display anv goods or merchandise, on a <br />pedestrian walkway in a manner that obstnicts or unreasonably impairs the use of any <br />pedestrian walkway. For purposes of this section, a pedestrian walkway shall be deemed <br />to be obstructed or its use unreasonably impaired if any goods or merchandise are stored, <br />offered for sale, or in any other manner or for any other purpose placed upon the <br />pedestrian walkway so that the remaining width of the walkway at such place or location <br />available for unimpeded pedestrian travel is reduced to less than six feet. <br />(c) A violation of this section shall constitute a misdemeanor, punishable by a <br />fine that shall not be less than $100.00 nor exceed $250.00. For purposes of this <br />paragraph, each day during which such violation continues shall constitute a separate <br />violation. <br />SECTION 2: That all ordinances, and parts of ordinances, inconsistent or in <br />conflict with this Ordinance, shall, to the extent of such inconsistency or conflict, be <br />repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this legislation go into effect immediately <br />before spring sidewalk sales begin and pedestrian safety is jeopardized by retail <br />establishments obstructing pedestrian walkways, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED: J~j a.00,6 <br />First Reading: ~ ~/ ~~ <br />Second Reading: 0(~ <br />Third Reading.• ~ D 6 <br />Committee: ,,,~{ i.~;,~ E ~ 4~ t/.it.c, <br />ATTEST: <br />f <br />ARBARA L.
