..~,.~, <br />4~ <br />Resolution No. 2006-49 <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council hereby records its objection to the transfer of ownership <br />of Liquor Permit No. 9052532 at 29047 Lorain Road, North Olmsted, Ohio, from Trimus LLC, <br />dba "Krobar," to Mark Hammond Enterprises, Inc., and, pursuant to ORC Section 4303.26, <br />requests that the Director of Liquor Control set a hearing to be held in Columbus on the <br />advisability of transferring ownership of said permit. <br />SECTION 2: That the Clerk of Council be and she is hereby directed to transmit two <br />(2) certified copies of this Resolution, together with two (2) copies of a letter of objection, and a <br />statement by the Director of Law that, in the Director's opinion, that the objection is based upon <br />substantial legal grounds within the meaning and intent of division (A) of Section 4303.292 of <br />the Revised Code to the Director of Liquor Control. <br />SECTION 3: That the Director of Law be and he hereby is authorized and directed to <br />prosecute this matter before the Division of Liquor Control on behalf of the North Olmsted City <br />Council. <br />SECTION 4: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to meet the <br />February 10, 2006, deadline for objections to the said transfer of ownership of liquor permit, and <br />further provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />~~ <br />PASSED. ,~r,Cl~.c.~-a o 0 <br />A <br />~~ <br />ARA L.
