.... <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2006 - 48 <br />BY: Mayor O'Grady and the Entire City Council <br /> <br />AN ORDINANCE CREATING NEW CHAPTER 763 (PUBLIC DANCE <br />HALLS; TEEN DANCE CLUBS) OF THE NORTH OLMSTED CODIFIED <br />ORDINANCES IN ORDER TO REGULATE DANCE HALLS AND TEEN <br />DANCE CLUBS, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, over the course of the last two years, the North Olmsted police department <br />has on numerous occasions been called to respond to a business establishment in the City that <br />holds weekly teen dances; and <br />WHEREAS, these teen dances have attracted youths from a 30 mile radius outside of <br />North Olmsted and have generated a multitude of arrests for violations of many State and local <br />laws, including assault, disorderly conduct, underage possession, underage consump+~~n, <br />possession of marijuana, felony drug trafficking, felony vandalism, excessive noise, curfew <br />violations, and public indecency; and <br />WHEREAS, such incidents threaten the health and safety of children in the North <br />Olmsted community, as well as place a severe strain upon the safety resources of the City; and <br />WHEREAS, this Council believes that reasonable regulation of dance halls and teen <br />dance clubs will protect and promote the health, safety and welfare of teenage children in the <br />North Olmsted community, and will serve to relieve some of the said strain upon the resources of <br />the City's police and fire departments, so that ultimately the City may more effectively serve all <br />of the residents and business owners of North Olmsted; and <br />WHEREAS, it is accordingly the desire of this Council to establish reasonable business <br />regulations that directly addresses the problems that the City has found exist in the City as a <br />result of the operations of unregulated teen dances at business establishments; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Chapter 763 (Public Dance Halls; <br />Teen Dance Clubs) of the North Olmsted Codified Ordinances, which, as created, shall read as is <br />set forth in Exhibit A attached to this Ordinance and hereby incorporated into this Ordinance as <br />if fully rewritten herein. <br />SECTION 2: That all ordinances or parts of ordinances or resolutions that are <br />inconsistent or in conflict with any of the provisions of newly created Chapter 763 are hereby <br />repealed to the extent of such inconsistency or conflict only. <br />
