~:: <br /> <br />763.16 COMPLIANCE WITH HEALTH, BUILDING AND FIRE REGULATIONS. <br />No public dance hall shall operate a public dance and no teen dance club shall be licensed to operate a teen <br />dance until it is found that such hall or club complies with and conforms to all ordinances and to all health, building <br />and fire regulations of the City; that it is property ventilated and supplied with sufficient toilet conveniences, and is a <br />safe, sanitary and proper place for the purpose for which it is to be used. For the purposes of carrying out the <br />provisions of this section, all initial and renewal applications for teen dance club licenses shall be endorsed by the <br />City Building Commissioner and the Chief of the Fire Division, that such building complies with the rules of their <br />several departments before a license shall be issued as provided herein. <br />763.17 ACCESS TO SAFETY FORCES PERMITTED. <br />For purposes of enforcement of the provisions of this Chapter, teen dance club license holders, and all <br />owners and operators of public dance halls and teen dance clubs, shall permit on duty members of the North <br />Olmsted Police, Fire and Building Departments, as a condition to retaining their license and/or lawfully conducting <br />their business in the City of North Olmsted, to have access during all hours of operation of said public dance halls <br />and teen dance clubs to all rooms, spaces and areas therein that are open to the public. <br />763.18 SEVERABILITY CLAUSE. <br />If for any reason one or more sections, paragraphs, sentences, clauses or other parts of this Chapter are held <br />by any court to be illegal, unconstitutional or otherwise invalid, such holding or judgment shall not affect, impair or <br />invalidate the remaining provisions of this Chapter, but shall be confined in its operation to the specific sections, <br />paragraphs, sentences, clauses, or other parts of the Chapter held or adjudged invalid, and the invalidity of any <br />section, paragraph, sentence, clause, or part of this Chapter in any one or more instances shall not attest or prejudice <br />in any way the validity of this Chapter in any other instance. <br />763.99 VIOLATIONS; PENALTIES; OTHER CITY REMEDIES <br />(a) Whoever violates any provision of this Chapter shall be guilty of a minor misdemeanor. If the offender <br />has, within a three month period, previously been convicted of any violation of this chapter, then a violation shall be <br />a misdemeanor of the first degree. <br />(b) Except where specified, or otherwise required by law, a culpable mental state is not required to be <br />established for the commission of any offense under this Chapter. Where a culpable mental state is required by law, <br />an offense is committed when the proscribed act is done "knowingly." <br />(c) Any person who operates or causes to be operated a teen dance club without a valid license, or <br />otherwise engages in a pattern or commits a series of violations of this Chapter, shall be subject to a suit for <br />injunction, brought by the Director of Law on behalf of the City of North Olmsted, as well as prosecution for <br />criminal violations and license suspension or revocation. <br />10 <br />
