mm <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0.2006 - 4 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR, ON BEHALF OF <br />THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH THE NORTH OLMSTED SCHOOL DISTRICT, <br />GRANTING THE SCHOOL DISTRICT A LICENSE TO INSTALL <br />AND MAINTAIN A REMO VABLE FENCE ON DIAMOND NUMBER <br />ONE BASEBALL FIELD AT NORTH OLMSTED PARK, AND <br />DECLARING AN EMERGENCY <br />WHEREAS, it is the desire of the North Olmsted School District to install a <br />removable fence on Diamond Number One Baseball Field at North Olmsted Park for the <br />use of North Olmsted school baseball teams; and <br />WHEREAS, the City Recreation Commissioner has reviewed and supports the <br />request by the North Olmsted School District; and <br />WHEREAS, it is the desire therefore of this Council to authorize the Mayor to <br />enter into an Agreement with the North Olmsted School District granting it a license to <br />install and maintain a removable fence on Diamond Number One Baseball Field at North <br />Olmsted Park; <br />NO W THEREFORE, BE IT RESOL VED B Y THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into an Agreement with the North Olmsted School District, <br />granting to the latter a license to install and maintain a removable fence on Diamond <br />Number One Baseball Field at North Olmsted Park, in accordance with the plans and <br />specifications provided to the Recreation Commissioner. <br />SECTION 2: That the agreement between the City of North Olmsted and the <br />North Olmsted School District shall be in the form and substance as approved by the <br />Mayor and the Director of Law, with only such changes therein as are not substantially <br />adverse to the City and which are approved by the Mayor and the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval <br />of the agreement by the Director of Law. <br />
