RESOLUTION N0. 77 - ~ BY : MR. BOEHMER A RESOLUTION AUTHORIZING THE FILING OF A PETITION IN THE COURT OF COMMON PLEAS OF CUYAHOGA COUNTY FOR THE ORGANIZATION OF A REGIONAL WATER DISTRICT PURSUANT TO CHAPTER 6119, OHIO REVISED CODE, AUTHORIZING THE MAYOR AND THE DIRECTOR OF LAW OF THIS CITY TO SIGN SUCH PETITION ON BEHALF OF THE CITY OF NORTH OLMSTED. WHEREAS, Chapter 6119, Ohio Revised Code, provides for the organization and creation of a regional water district, for the purpose of supplying water to users within and without the district, pursuant to procedures initiated by a petition signed by one or more municipal corporations, and WHEREAS, such petition is rec{uired to contain, among other things, a general description of the territory to be included in the proposed regional water district, and WHEREAS, this City, together with other municipal corporations in Cuyahoga County, is now and has been provided with water by the City of Cleveland, and WHEREAS, the establishment of a regional water district to consist of all of the territory located within the boundaries of Cuyahoga County, except the territory located within the corporate limits of the City of Cleveland, would create an independent political subdivision which could effectively supply water to users within and without such regional water district. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council authorizes the filing of a petition in the Court o Common Pleas of Cuyahoga County for the organization of a regional water district pursuant to Chapter 6119, Ohio Revised Code. Such petition shall be substantially in the form of the petition now on file with the Clerk of this Council, which form is hereby approved, but such petition as filed shall include as petitioners for such regional water district such additional municipal corporations as by action of their respective legislative authorities authorize the filing of the petition and its signing. The form of such petition shall be subject to such changes as may be approved by the Mayor and the Director of Law, and their signing of such petition shall constitute such approval, provided that the authorized purpose of such proposed district and the territory to be included in such proposed district as stated in the form of such petition now on file in the office of the Clerk of Council, shall not be changed without the authorization of this Council.
