. a ..... <br /> <br />CITY OF NORTH OLMSTED, OHIO <br />ORDINANCE N0. 77 - ~~ <br />BY. <br /> <br />AN ORDINANCE ENACTING A NEW SECTION <br />533.11 ENTITLED "DISSEMINATING OR <br />DISPLAYING MATERIAL HARMFUL TO JUVENILES" <br />OF CHAPTER 533 ENTITLED "OBSCENITY AND SEX <br />OFFENSES'' OF THE CODIFIED ORDINANCES OF <br />THE CITY OF NORTH OLMSTED, AND REPEALING <br />SECTION 533.11 AS PREVIOUSLY ADOPTED. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby adopted a new Section 533.11 <br />entity "Disseminating or Displaying Material Harmful to Juveniles" <br />which shall read as follows: <br />"533.11 DISSEMINATING OR DISPLAYING MATERIAL HARMFUL TO JUVENILES. <br />A. It shall be unlawful for any owner or manager, or his <br />agent or employee, of a business establishment selling books, <br />newspapers, art objects, motion picture products, or other like items, <br />to do any of the following: <br />1. To knowingly display or permit to be displayed any <br />material or performances which would be harmful to <br />juveniles as defined by Section 533.01(E) of this <br />Chapter, in such a manner or in such a location within <br />his business establishment that the offensive material <br />or performance may at any time, or in any manner, be <br />viewed by juveniles; <br />2. To knowingly display or permit the display, on or within <br />the establishment, of any advertisement, relating to <br />any material which is obscene or harmful to juveniles, <br />which is graphic or which is worded in such a manner as <br />to render the advertisement itself obscene or harmful <br />to juveniles as defined in Sections 533.01 (E) and (F) <br />of the Codified Ordinances of the City of North Olmsted. <br />B. No person, with knowledge of its character, shall recklessly <br />furnish or present to a jevenile any material or performance which is <br />harmful to juveniles. <br />C. The following are affirmative defenses to a charge under this <br />section, involving material or a performance which is harmful to <br />juveniles: <br />1. The defendant is the parent, guardian or spouse of the <br />.juvenile involved. <br />2. The juvenile involved, at the time the material or <br />performance was presented to him was accompanied by his <br />parent or guardian, who, with knowledge of its character, <br />consented to the material or performance being furnished <br />or presented to the juvenile. <br />
