. ~' i <br />'. <br />S` <br />„< <br />CITY OF NORTH OLA4STED, OHIO <br />ORDINANCE N0. 77 - <br />BY: <br />i~ <br />AN ORDINANCE GIVING THE CONSENT OF <br />THE CITY OF NORTH OLMSTED AND <br />AUTHORIZING THE MAYOR TO ENTER INTO <br />A MAINTENANCE AND PARKING AGREEMENT <br />IN THE MATTER OF THE IMPROVEMENT OF <br />CLAGUE ROAD, AND DECLARING AN EMERGENCY. <br />WHEREAS, the County of Cuyahoga and/or the State of Ohio <br />Department of Transportation is considering the improvement of the <br />public highway which is described as follows: <br />Increasing the structural adequacy of pavement <br />by applying an overlay of asphalt concrete and <br />adjust castings to grade where necessary on <br />CLAGUE ROAD from LORAIN ROAD to the NORTH OLMSTED <br />CORPORATION LINE. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That it is declared to be in the public interest <br />that t e consent of the Council of the City of North Olmsted~.be and <br />such consent is hereby given to the County of Cuyahoga and/or the <br />State of Ohio Department of Transportation, to construct the above <br />described improvement, in accordance with the plans, specifications, <br />and estimates as approved by the County and/or the State of Ohio <br />Department of Transportation. <br />SECTION 2: That the City of North Olmsted hereby proposes to <br />cooperate with the County and/or the State of Ohio Department of <br />Transportation in the costs of the above described improvement as <br />follows: <br />A. By the approval of an application for municipal cooperation <br />with the County in the cost of the improvement project <br />to the extent of funds received by an allocation from <br />the County Motor Vehicle $5.00 License Tax Fund. <br />B. There shall be no roadway participation by the City of <br />North Olmsted for the aforesaid improvement other than <br />$5.00 License Tax Funds. <br />SECTION 3: That the Mayor be and he is hereby authorized to <br />enter into maintenance and parking Agreements and Special Contractual <br />Obligations, a copy of which said Agreement is attached hereto and <br />made apart hereof as though fully rewritten herein and marked <br />Exhibit "A". <br />SECTION 4: That upon completion of said improvement, the City <br />of North Olmste will thereafter keep said highway open to traffic <br />at all times, and; <br />A. Maintain the improvement in accordance with the <br />provisions of the statutes relating thereto and make <br />ample financial provisions for such maintenance; <br />B. Maintain the right-of-way and keep it free of obstructions <br />in a manner satisfactory to the County and/or the <br />Department of Transportation of the State of Ohio, and <br />hold said right of way inviolate for public highway <br />purposes and permit no signs, posters, billboards, <br />roadside stands or other private installations within <br />
