<br />~. <br />ORDINANCE NO. - 7 <br />By Gtr ,/ ~. <br />/. <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE <br />IMPROVEMENT OF MILL ROAD FROM PORTER ROAD TO <br />DOVER CENTER ROAD BY CONSTRUCTING A CONCRETE <br />SIDEWALK, AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio: <br />Section 1. That it is hereby determined to proceed with the <br />improvement of Mill Road from Porter Road to Dover Center Road by con- <br />structing a concrete sidewalk on the south side of said street. <br />Section 2. That said improvement shall be made in accordance with <br />the provisions of Resolution No. 77-29 adopted March 1, 1977, and with <br />the plans, specifications, estimates and profiles heretofore approved and <br />now on file in the office of the Clerk of this Council. <br />Section 3. That all claims for damages resulting therefrom that <br />have been legally filed shall be inquired into after completion of the pro- <br />posed improvement, and the Director of Law is hereby authorized and directed <br />to institute legal proceedings in a court of competent 3urisdiction to in- <br />quire into claims that have been so filed. <br />Section 4. That portion of the cost provided in the above mentioned <br />resolution of necessity to be assessed shall be assessed in the manner and the <br />number of installments provided in said resolution and on the lots and lands <br />described therein. <br />Section 5. That the estimated assessments heretofore prepared by <br />the City Engineer and filed in the office of the Clerk of Council and as <br />confirmed by the Assessment Equalization Board appointed for such purpose <br />by Resolution No. 77-29 adopted on March 1, 1977, the report of which Board <br />was approved by Resolution No. - adopted G`~,~, 1977, <br />be and the same are hereby adopted. <br />Section 6. The Clerk of this Council is hereby directed to deliver <br />a certified copy of this ordinance to the County Auditor within fifteen days <br />after its passage. <br />Section 7. The Mayor is hereby authorized and directed as soon as <br />the funds therefor are available to make and execute a contract for said <br />improvement with the lowest and best bidder and the improvement shall be <br />financed as provided in Resolution No. 76-85. <br />Section 8. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br />
