BY: <br />ORDINANCE NO. 77 - 7/ <br />.---•. <br />AN ORDINANCE ACCEPTING AN EASEMENT <br />FOR A WATER MAIN SERVICING THE <br />NORTH OLMSTED EVANGELICAL FRIENDS <br />CHURCH LOCATED ON THE NORTHERLY "- <br />SIDE OF BUTTERNUT RIDGE ROAD FROM <br />THE NORTH OLMSTED EVANGELICAL FRIENDS <br />CHURCH. <br />WHEREAS, the Engineering Department of the City of <br />North Olmsted has determined that it is necessary to establish <br />an easement through which the N®rth Olmsted Evangelical <br />Friends Church will be serviced relating to water supply <br />services, and <br />WHEREAS, It is the desire of the City of North Olmsted <br />and North Olmsted Evangelical Friends Church, the owners of the <br />subject parcel, to have the City's rights in said water main <br />clearly specified and made a matter of record by recording a <br />formal easement, and <br />WHEREAS, This Council deems it in the best interest of_ the <br />City of North Olmsted to accept said easement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND 5'J'A'I'E OF OHIO: <br />SECTION 1: This Council does hereby accept an easement <br />from North 0 msted Evangelical Friends Church for the maintenance, <br />construction and operation of a water main under and on the property <br />described herein and more fully described in the copy of the easement <br />attached hereto and made a part hereof and marked Exhibit "A". <br />SECTION 2: That the Director of Finance is hereby directed <br />to pay to Nort Olmsted Evangelical Friends Church the sum of <br />One Dollar ($1.00) as consideration for the granting of the ease- <br />ment described herein. <br />SECTION 3: That the Engineering Department of the City <br />of North Olmsted is hereby directed to cause the easement to be <br />recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this Ordinance shall take effect and be <br />in force from and after the earliest period allowed by law. <br />PASSED: <br />ATTEST: <br />~~~ ~ _ <br />NORA T.
