"`' <br /> <br /> <br />NOW, THEREFORE, the CITY OF NORTH OLMSTED and the CITY OF WESTLAKE <br />do hereby promise and agree that: <br />Section 1. The CITY OF WESTLAKE agrees that it will, subject to <br />the provisions hereof and the rules and regulations from time to time <br />adopted by the CITY OF NORTH OLMSTED, purchase from the CITY OF NORTH <br />OLMSTED -the supply of 'TServices'T to the full extent required for the <br />use and developement of said Subdivision in the CITY OF WESTLAKE and <br />the CITY OF NORTH OLMSTED, likewise subject to such provisions and <br />regulations; agrees to supply such 'TServices'T to the said Subdivision <br />provided,.. however, that it is expressly understood and agreed that. <br />unless the CITY OF NORTH OLMSTED-shall by supplement hereto agree to <br />greater requirements, the 'tServices'T to be provided by the CITY OF <br />NORTH OLMSTED to the CITY OF WESTLAKE shall consist of the treatment of <br />domestic sewage to which no chemicals have been added, and with the <br />following limitations: <br />(a) the average flow rate shall not exceed 77,200 gallons per 24-hour <br />day and the peak flow rate shall not exceed 310,000 gallons per 24-hour <br />day; (b) the average BOD loading not to exceed 3Q0 milligrams per liter <br />(c) the average suspended solids not to exceed 300 milligrams per liter; <br />and (d) the ph to neither exceed 9.0 nor fall below 6.0. The 'tServicest <br />hereunder shall include the collection, treatment, and disposal of such <br />sanitary sewage and waste as may be permitted under the rules and <br />regulations established herein and shall not include the collection, <br />treatment, and disposal of surface water drainage. <br />Section 2. It is further mutually understood and agreed that the <br />connection for the supply of 'rServicestf shall be at a point determined <br />by the CITY OF NORTH OLMSTEDTs ENGINEER which shall be located on the <br />Corporate Line of the CITY OF WESTLAKE. Further, this AGREEMENT does <br />not obligate the CITY OF NORTH OLMSTED to construct or finance any <br />service line connections between the point of delivery as designated by <br />the CITY OF NORTH OLMSTEDts ENGINEER and extending from such point of <br />connection to the CITY OF NORTH OLMSTEDts utility system. <br />Page 2 <br />
