CITY OF NORTH OLMSTED RESOLUTION N0. ~~,,~ By G~;~ ' A RESOLUTION APPOINTING AN ASSESSMENT EQUALIZATION BOARD TO HEAR OBJECTIONS RELATIVE TO THE ASSESSMENTS FOR THE MILL ROAD SIDEWALK IMPROVEMENT, REPEALING RESOLUTION N0. 76-150, AND DECLARING AN EMERGENCY. WHEREAS, an Assessment Equalization Board was appointed by Resolution No. 76-150, adopted November 3, 1976, to hear and determine the objections to the Mill Road sidewalk improvement; and WHEREAS, the oath of office was not administered to the members of the Board prior to the hearing of the objections as required by law, thereby bringing into question the validity of the Board's hearing, and this Council has determined to reappoint the Board and to fix a new date for hearing the objections to the estimated assessments for said improvement; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga County, Ohio: Section 1. That H~r~~ev DE•nk , James Redovian and _$3ynlDnr~ RE?ni ~Pk , three disinterested freeholders of said City be and they are hereby appointed to act as an Assessment Equalization Board to hear and determine all timely written objections to the estimated assessments heretofore reported to this Council of the cost of improving Mill Road from Porter Road to Dover Center Road by constructing a concrete sidewalk on the south side of said street, and to equalize the same as to them seems proper, in accordance with law and with Resolution No. 76-85 adopted by this Council on July 1, 1976. Section 2. The Board shall first meet for the above purpose at the Council Chamber in the City Hall on the ~~ day of ~1ar~ , 1977, at 5:0~ p.m., and upon the completion of such equalization shall report such equalized assessment to Council. Section 3. That Resolution No. 76-150, adopted November 3, 1976, having been superseded by this resolution, is hereby repealed. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
