<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. ~~,,~ <br />By G~;~ ' <br />A RESOLUTION APPOINTING AN ASSESSMENT EQUALIZATION <br />BOARD TO HEAR OBJECTIONS RELATIVE TO THE ASSESSMENTS <br />FOR THE MILL ROAD SIDEWALK IMPROVEMENT, REPEALING <br />RESOLUTION N0. 76-150, AND DECLARING AN EMERGENCY. <br />WHEREAS, an Assessment Equalization Board was appointed by Resolution <br />No. 76-150, adopted November 3, 1976, to hear and determine the objections <br />to the Mill Road sidewalk improvement; and <br />WHEREAS, the oath of office was not administered to the members of <br />the Board prior to the hearing of the objections as required by law, thereby <br />bringing into question the validity of the Board's hearing, and this Council <br />has determined to reappoint the Board and to fix a new date for hearing the <br />objections to the estimated assessments for said improvement; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio: <br />Section 1. That H~r~~ev DE•nk , James Redovian <br />and _$3ynlDnr~ RE?ni ~Pk , three disinterested freeholders of said <br />City be and they are hereby appointed to act as an Assessment Equalization <br />Board to hear and determine all timely written objections to the estimated <br />assessments heretofore reported to this Council of the cost of improving <br />Mill Road from Porter Road to Dover Center Road by constructing a concrete <br />sidewalk on the south side of said street, and to equalize the same as <br />to them seems proper, in accordance with law and with Resolution No. <br />76-85 adopted by this Council on July 1, 1976. <br />Section 2. The Board shall first meet for the above purpose <br />at the Council Chamber in the City Hall on the ~~ day of ~1ar~ , <br />1977, at 5:0~ p.m., and upon the completion of such equalization shall <br />report such equalized assessment to Council. <br />Section 3. That Resolution No. 76-150, adopted November 3, 1976, <br />having been superseded by this resolution, is hereby repealed. <br />Section 4. It is found and determined that all formal actions <br />of this Council concerning and relating to the adoption of this resolution <br />were adopted in an open meeting of this Council, and that all deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br />
