'] ~ ~9 <br />BY : ~x~/, <br />AN ORDINANCE REGULATING THE DISPOSAL OF BUILDING <br />MATERIALS, SCRAP, AND OTHER REFUSE GENERATED DURING <br />THE CONSTRUCTION OR RECONSTRUCTION OF DWELLINGS, <br />BUILDINGS OR OTHER STRUCTURES <br /> <br />WHEREAS, it has been brought to the attention of the Engineering <br />Department and the Building Department that settling problems often <br />occur in the area of new home and/or building condxuction due to the <br />burial of scrap building materials,' refuse, tree stumps and like <br />material, and <br />WHEREAS, the occupier of said property encounters problems at <br />a later time with respect to settling and the necessity of regrading <br />said property, and <br />WHEREAS, it is the desire of this Council to regulate any such <br />activity. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: No builder, contractor, developer or owner of property <br />shall be permitted to bury tree stumps, limbs,. brush, scrap building <br />materials, scrap pipe or other refuse which is generated through con- <br />struction, reconstruction or development of land or buildings. Such <br />substances shall be hauled away from the site and disposed of in any <br />and all methods allowed by law. <br />SECTION 2: Any person who violates Section 1 of this ordinance shall <br />be guilty of a minor misdemeanor, which carries a fine of not more than <br />$100.00; each day said violation is permitted to continue to exist shall <br />be considered to be a separate offense. <br />SECTION 3: Nothing contained herein shall be construed so as to <br />limit the City of North Olmsted from bringing an action either in equity <br />or law with respect to the enjoining of any activity prohibited by this <br />ordinance. Further the City shall have as an additional remedy the <br />revocation of the contractor's license with respect to any contractor <br />who violates the provisions of this ordinance. <br />SECTION 4: That this ordinance shall take effect and be in force <br />from and af/ter-th/e earliest period allowed by law. <br />PASSED: ~i~~~[-~.C~ <br />ATTEST: -J/ ~/~ <br />NORA T.
