-. <br />w, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 77 -~6 <br />BY : i~~r/_ <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF A <br />SINGLE DWELLING (SHOE REPAIR SHOP) AND DETACHED <br />GARAGE LOCATED ON PERMANENT PARCEL N0. 237-7-19 <br />ON LORAIN ROAD IN THE CITY OF NORTH OLMSTED, AND <br />DECLARTNG AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance Nos. 1331.01 <br />to 1332.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the single dwelling <br />(shoe repair shop) and detached garage located on Permanent Parcel <br />No. 237-7-19, and further known as 23597 Lorain Road in the City <br />of North Olmsted, the record title holder being Sam Taormina, is <br />unsafe, dangerous to human life and a hazard to the safety, health <br />and public welfare of the citizens of North Olmsted, and <br />WHEREAS, notice to repair, remove and demolish said buildings <br />was served by certified mail on said record title holder on <br />September 28, 1976, ordering said title holder to repair, remove <br />or demolish said two buildings and to commence such repair, <br />removal or demolition within forty-eight hours of receipt of said <br />notice, and <br />WHEREAS, said notice informed the record title holder of his <br />right to appeal condemnation order of the Building Commissioner <br />within fifteen days, and <br />WHEREAS, said record title holder, Sam Taormina, has failed <br />to file an appeal within fifteen days as provided by Section 1131.05 <br />of the Codified Ordinances. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLPdSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council deems it necessary to proceed <br />with t e emolition and removal of the single dwelling (shoe repair <br />shop) and detached garage at 23597 Lorain Road, North Olmsted, Ohio, <br />also known as Permanent Parcel No. 237-7-19, owned by Sam Taormina, <br />under the emergency authority of Codified Ordinance No. 1331.07, <br />by reason of the fact that said single dwelling (shoe repair shop) <br />and detached garage has been determined to be dangerous to human <br />life and a hazard to the public safety, health and welfare of the <br />citizens of the City of North. Olmsted, and that the cost of said <br />demolition and removal be paid from the General Fund of the City of <br />North Olmsted and charged to the owner as a special assessment or <br />lien on said parcel of land, and assessed and collected in the <br />manner of other assessments as provided by law. <br />
