,~. c.,' <br />,. <br />.,~w <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 77 - g <br />BY : ~~~/ <br />AN ORDINANCE AUTHORIZING THE BUILDING COP~IISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF A <br />DETACHED GARAGE LOCATED ON PERMANENT PARCEL N0. <br />235-13-81,82, ON PORTER ROAD, IN THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMERGENCY <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 <br />to 1332.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the detached garage <br />located on Permanent Parcel No. 235-13-81,82 and further known as <br />5816 Porter Road in the City of North Olmsted, the record title <br />holder being Eugene W. Mealey, is unsafe, dangerous to human life <br />and a hazard to the safety, health and public welfare of the <br />citizens of North Olmsted, and <br />WHEREAS, notice to repair, remove and demolish said building <br />was served by certified mail on said record title holder on October 25, <br />1976, ordering said title holder to repair, remove or demolish said <br />detached garage and to commence such repair, removal or demolition <br />within forty-eight hours of receipt of said notice, and <br />WHEREAS, said notice informed the record title holder of his <br />right to appeal condemnation order of the Building Commissioner <br />within fifteen days, and <br />WHEREAS, said record title holder, Eugene W. A~ealey, has failed <br />to file an appeal within fifteen days as provided by Section 1131.05 <br />of the Codified Ordinances. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council deems it necessary to proceed <br />with Memo it tion and removal of the detached garage at 5816 Porter <br />Road, North Olmsted, Ohio, also known as Permanent Parcel No. 235-13-81, <br />82 owned by Eugene W. Mealey, under the emergency authority of <br />Codified Ordinance No. 1331.07, by reason of the fact that said detached <br />garage has been determined to be dangerous to human life and a hazard <br />to the public safety, health and welfare of the citizens of the City <br />of North Olmsted, and that the cost of said demolition and removal <br />be paid from the General Fund of the City of North Olmsted and charged <br />to the owner as a special assessment or lien on said parcel of land, <br />and assessed and collected in the manner of other assessments as <br />provided by law. <br />SECTION 2: That upon the completion of the demolition and <br />remova~tFie Director of Finance is directed to immediately pay for <br />the services rendered to the contractor employed by the City. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />
