,~>,~, ,~ <br />~.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 77 -~ <br />AN ORDINANCE DESIGNATING THE COUNCIL <br />CHAMBERS LOCATED WITHIN THE CONFINES <br />OF CITY HALL AS BEING A PLACE OF PUBLIC <br />ASSEMBLY WHERE NO SMOKING IS PERMITTED <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio Legislature adopted Section 3791.031 of <br />the Ohio Revised Code and which became effective on January 1, <br />1977, and <br />WHEREAS, said section mandates that certain areas of public <br />assembly be declared NO SMOKING areas, and <br />WHEREAS, said section further provides that the local <br />legislative authority designate the appropriate individual to <br />enforce regulations regarding NO SMOKING in places of public <br />assembly, and <br />WHEREAS, it is the desire of this Council to prohibit <br />smoking in Council Chambers. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council of the City of North Olmsted <br />hereby esignates that the Council Chambers is a place of public <br />assembly with a seating capacity of 50 or more seats and further, <br />that there shall be NO SMOKING permitted in said Council Chambers. <br />SECTION 2: That the Council of the City of North Olmsted <br />does hereby designate the Fire Chief of the City of North Olmsted <br />as the proper authority for the placing of signs indicating that <br />the Council Chambers is a NO SMOKING area. <br />SECTION 3: That no person. shall smoke in the Council Chambers. <br />SECTION 4: That anyone who violates this ordinance shall be <br />guilty ova minor misdemeanor, the penalty for which is a maximum <br />fine of One Hundred Dollars ($100.00). <br />SECTION 5: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is necessary to implement the provisions of Ohio Revised Code <br />Section 3791.031, which became effective on January 1, 1977, and <br />further provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: ~ <br />ATTEST: <br /> <br />Nora T.
