Of the remaining portion of said levy, an amount shall annually be levied sufficient to pro- vide the amounts required by law for police pensions (.3) mill, and firemen's pensions (.3) mill; an amount shall be annually levied for the purpose of paying the expense of recreation and providing recreational facilities (.5) mill, and the balance tYiereof may annually be levied for [the purpose of paying the current operating expenses of the municipality] [any other lawful municipal purpose]. (c) Council may, without a vote of the people, levy annually in addition to the eleven and one-tenth (11.1) mills provided for in Paragraph (b) of this Section 8, such tax not in excess of three (3) mills for each dollar of assessed valuation as may be required to provide for the payment of the interest, sinking fund and retire- ment charges on general obligation bonds issued prior to January 1, 1976 without the authority of the electors for the purpose of constructing improvements to the municipal sanitary sewerage system and to provide for the payment each year to the Ohio Water Development Authority of the amounts required to be paid by the municipality in payment of the loan from the Authority made for the purpose of constructing improvements to the municipal sanitary sewerage system." Section 2. That if such amendment is approved by a majority of the electors voting thereon at such election, it shall become effective from and after the time of its approval by the electors. Section 3. That the Clerk of Council is hereby authorized and directed to cause a copy of the proposed Charter amendment to be published in such manner as may be authorized by law. Section 4. That the Clerk of this Council be and he is hereby authorized and directed to forward a certif ied copy of this ordinance to the Board of Elections of Cuyahoga County. Section 5. That the Board of Elections is hereby requested to cause appropriate notice of such election to be duly given in accordance with law. Section 6. That there is hereby appropriated from the general fund of the City an amount sufficient to pay the cost of carrying out the directions of this ordinance including the costs incurred for the special election provided for herein as required by Section 3701.17 of the Ohio Revised Code and the cost of publishing said proposed Charter amendment. Section 7. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 8. That this ordinance is hereby determined to be an emergency measure necessary for the immediate preservation of the public peace, property, health and safety of the City and for the further reason that this ordinance must be immediately effective in order to permit necessary arrangements to be made in sufficient time for said election; wherefore, this ordinance shall take effe d be in force immediately upon it assage.
