Of the remaining portion <br />of said levy, an amount shall annually be levied sufficient to pro- <br />vide the amounts required by law for police pensions (.3) mill, <br />and firemen's pensions (.3) mill; an amount shall be annually levied <br />for the purpose of paying the expense of recreation and providing <br />recreational facilities (.5) mill, and the balance tYiereof may <br />annually be levied for [the purpose of paying the current operating <br />expenses of the municipality] [any other lawful municipal purpose]. <br />(c) Council may, without a vote of the people, levy annually <br />in addition to the eleven and one-tenth (11.1) mills provided for <br />in Paragraph (b) of this Section 8, such tax not in excess of three <br />(3) mills for each dollar of assessed valuation as may be required <br />to provide for the payment of the interest, sinking fund and retire- <br />ment charges on general obligation bonds issued prior to January 1, <br />1976 without the authority of the electors for the purpose of <br />constructing improvements to the municipal sanitary sewerage <br />system and to provide for the payment each year to the Ohio <br />Water Development Authority of the amounts required to be paid <br />by the municipality in payment of the loan from the Authority <br />made for the purpose of constructing improvements to the municipal <br />sanitary sewerage system." <br />Section 2. That if such amendment is approved by a majority of <br />the electors voting thereon at such election, it shall become effective from <br />and after the time of its approval by the electors. <br />Section 3. That the Clerk of Council is hereby authorized and <br />directed to cause a copy of the proposed Charter amendment to be published <br />in such manner as may be authorized by law. <br />Section 4. That the Clerk of this Council be and he is hereby <br />authorized and directed to forward a certif ied copy of this ordinance to the <br />Board of Elections of Cuyahoga County. <br />Section 5. That the Board of Elections is hereby requested to cause <br />appropriate notice of such election to be duly given in accordance with law. <br />Section 6. That there is hereby appropriated from the general fund <br />of the City an amount sufficient to pay the cost of carrying out the directions <br />of this ordinance including the costs incurred for the special election provided <br />for herein as required by Section 3701.17 of the Ohio Revised Code and the cost <br />of publishing said proposed Charter amendment. <br />Section 7. That it is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all deliberations of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br />Section 8. That this ordinance is hereby determined to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health and safety of the City and for the further reason that this ordinance <br />must be immediately effective in order to permit necessary arrangements to be <br />made in sufficient time for said election; wherefore, this ordinance shall <br />take effe d be in force immediately upon it assage. <br />Passed: ~ 1977 <br />H.
