"I <br />CITY OF NORTH OLNISTED <br />ORDINANCE N0. 79- 128 <br />BY : ? 4&4-, <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />BUILDING ON PERMANENT PARCEL N0. 236-16-70 AT <br />24681 KENNEDY RIDGE ROAD, IN THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 <br />to 1331.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the abandoned dwelling <br />known as Permanent Parcel No. 236-16-70 located at 24681 Kennedy Ridge <br />Road, North Olmsted, Ohio, the record title holder being Nick Fragapane, <br />is unsafe, dangerous to human life, and hazardous to the safety, health <br />and public welfare of the citizens of the City of North Olmsted, and <br />WHEREAS, notice to repair, remove, or demolish said building <br />was served by registered letter on said record title holder on June 26, <br />1979, ordering said title holder to repair, remove, or demolish said <br />building and to commence such repair, removal, or demolition within <br />sixty (60) days of receipt of said notice, and <br />WHEREAS, said record title holder, Nick Fragapane, failed to <br />reverse the Building Commissioner's order and has also failed to further <br />appeal the decision of the Zoning Board of Appeals to a higher tribunal <br />of competent jurisdiction and at this time has failed to comply with <br />the order of the Building Commissioner. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Council deems it necessary to proceed with the <br />demolition and removal of the brick dwelling with attached garage at <br />24681 Kennedy Ridge Road, North Olmsted, Ohio, also known as Permanent <br />Parcel No. 236-16-70, owned by Nick Fragapane, whose mailing address <br />is 6586 Nancy Drive, North Olmsted, Ohio 44070, by reason of the fact <br />that said dwelling has been determined to be dangerous to human life <br />and a hazard to the public safety, health and welfare of the citizens <br />of the City of North Olmsted, Ohio, and that the cost of said demolition <br />in removal be paid from the General Fund of the City of North Olmsted <br />and charged to the owner as a special assessment or lien on such parcel <br />of land and assessed and collected in the manner of other assessments <br />as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />directed to o?rward a copy of this Ordinance to Nick Fragapane, <br />6586 Nancy Drive, North Olmsted, Ohio 44070. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that the <br />dilapidated condition of said dwelling with attached garage, is a <br />serious hazard to the health, safety, and welfare of the citizens of <br />Noxth Olmsted, and further provided it receives the affirmative vote <br />of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor.
