AN ORDINANCE APPROVING A MEMORANi)UM OF UNDFRSTkNDING WITH THE AMERICAN FEP,ERATION (1F STATE, COiLNTY AND M[JNICIPAL EMPLOYEES, ESTABLISHING THE RII"[[JNERATION FOR CERTAIN ENIPLOYFES IN Tf-E PLBLIC WOR.KS DIVISION OF THE DEPAR1MENT OF Pi1BLIC SERVICF OF THF CITY OF NORTH OLMSTED, AND REPF.ALING QRDINANCE N0. 77-170 ENACTED OCTOBER 18, 1977, AND DECLARING AN F!"1ERGENCY. WHFREAS, the City has entered into Memoranda of Understanding with the American Federation of State, County and D'funicipal Fmnloyees with respect to the compensation and other conditions of emnloyment of certain employees in the Public Works Division of the Ilepartment of Public Service of the City of North Olmsted, said Nlemoranda being authorized by Ordinance No. 73-115 enacted September 18, 1973, Ordinance No. 75-198 enacted Sentember 2, 1975, and Ordinance No. 77-170, enacted October 18, 1977, and JAJiEREAS, Pursuant to the nrovisions of the l`?emorandwn of Understanding nrovided for and incornorated in Ordinance No. 77-170, discussions have been conducted by the representatives of the City and representatives of_ the American Federation of State, County and Municipal Fmployees concerning revisions in and a renetaal of the Memorandwn of Understanding , and WFLFRI'.AS, understandings ha.ve been reached in the course of said dis- cussions with respect to the compensation and other conditions of employment of the emnloyees aforementioned. NO?AT, 1'fEREFORE, BF. IT ORDAINED BY THE C(1LiNCIL OF TI-iF CITY (1F N(lt?TH OIAISTF.D, COUN'I'Y OF CUYAHOGA AND STATE OF OHIO: SECTION l: T'hat the Memorandum of Understanding with the American Federation of State, County and Municipal Employees, attached hereto and made a nart hereof as though fully incorporated herein, is hereby adopted, ratified and approved and the Mayor is hereby authorized and directed to affix his signature thereto for and on behalf of the City of North Olmsted. SECTION 2: That all other ordinances or resolutions or parts of ordinances or parts of resolutions inconsistent herewith to the provisions of this ordinance and especially Ordinance No. 77-170, enacted on the 18th day o£ October, 1977, are hereby repealed with the effective date of this ordinance to the extent that they pertain to employees in the bargaining unit covered by the Memorandwn of Understanding and are inconsistent with this ordinance including the Memorandwn of linderstanding attached hereto and made a part hereof. SFCTION 3: That the Clerk of CoLmcil is hereby instructed to forward a cony of i?is t- ocr inance to the Director of Public Service and to the Director of Finance in order that the Director of Finance can nay the compensation authorized by this ordinance and the Mlemorandwn of L'nderstanding attached hereto and made a part hereof. SECTION 4: That this Clydinance is hereby declared to be an emergeney measure necessary?or t-He nreservation of the public peace, health, safety and welfare of the City by virtue of the fact of the irrnnediate necessity of adjusting to the recuirements of the various jobs. WHEREFORE, this Ordinance shall take effect and be in force irrnnediately upon its nassage, otherwise at the earliest neriod allowed by law.
