<br />TO PROCEED WITH THE DEMOLITION OR M?OVAL OF A
<br />NON-CONFORMING FENCF LC1(:ATED IN THE SETBACK AREA
<br />OF BUTTERNiTT RIDGE ROAD AND REVERE DRIVE CN PERMANENT
<br />PARCE L NCJT/IBER 2 3 5-16 - 6 AT 27137 BUT I'ERNU'I' RI DGE ROAD
<br />IN THE CITY OF NORTH OLMTED, AND DECLARING AN ENERGENCY.
<br />Wf-iEREAS, pursua.nt to the provisions of Ordinance No. 1331.01 to 1331.99
<br />of the Codified Ordinances of the City of North Olmsted, the Building Commissioner
<br />has determined that the fence located in the setback area on Permanent Parcel No.
<br />235-16-6 further lmown as 27137 Butternut Ridge Road, the record title holder
<br />being Bauer Development, is unsafe, dangerous to hwnan life, and hazardous to
<br />the safety, health and public welfare of the citizens of the City of North Olmsted,
<br />and
<br />WHEREAS, notice to repair, remove, and demolish said fence was served by
<br />registered letter on said record title holder on March 8, 1979, ordering said
<br />title holder to repair, remove, dr dbmolish said fence and to commence such repair,
<br />removal, or demolition, within sixty (60) days of receipt of said notice, and
<br />WHEREAS, said record title holder, Bauer Development Comnany, failed to
<br />file an appeal within fourteen (14) days as provided by Section 1331.05 of the
<br />Codified Ordinances, and ha.s failed to comply with the order of the Building
<br />Camonissioner.
<br />NOW, Tf-IEREFORE, BE IT ORDAINED BY THE COUNCIL OF TfE CITY OF NORTH OL2'4STED,
<br />COUN'IY OF CUYAHOGA AND STATE OF OHTO:
<br />SECTION 1: That this Council deems it necessary to proceed with the demolition
<br />and remova o t e fence located within the setback area on the west end of said
<br />parcel at 27137 Butternut Ridge Road, North Olmsted, Ohio, also laiown as Permanent
<br />Parcel No. 235-16-6, owned by Bauer Development Company, whose mailing address
<br />is Post Office Box 136, North Olmsted, Ohio 44070, by reason of the fact that
<br />said fence structure has been determined to be dangerous to hwnan life and a
<br />hazard to the public safety, health and welfare, of the citizens of the North
<br />Olmsted, and that the cost of said demolition and removal,be paid from the General
<br />Fund of the City of North Olmsted, and charged to the owner as a special assessment
<br />or lien on said parcel of land and assessed and collected in the manner of other
<br />assessments as provided by law.
<br />SECTION 2: That the Clerk of CoLmcil be and she is hereby directed to forward
<br />a copy o t is Ordinance to Bauer Development Company, Post Office Box 136, North
<br />Olmsted, Ohio 44070. SECTION 3: That this Ordinance is hereby declared to be an emergency
<br />measure inm?ediately necessary for the preservation of the public health, safety
<br />and welfare, and for the further reason that the dilapidated condition of said
<br />fence is a serious hazard to the health, safety, and welfare of the citizens of
<br />North Olmsted, and further provided it receives the affirmative vote of two-thirds
<br />of all members of Cowicil, it shall take effect and be in force immediately upon
<br />its passage and approval by the TIayor.
