,1_ <br />C I TY OF NORTH OLNISTED <br />ORDINANCE NO. 79-109 <br />BY <br />AN ORDINANCE ESTABLISHING Tf-E PROCEDURE TO BE FOLLObVED <br />?aI'IH RESPECT TO APPLICATIONS FOR BUILDING PERMITS ?VITHIN <br />FLOOD PRONE ARF.AS, AND DECLARING AN IlMERGENCY, AS Ar'IENDED. <br />WI-IEREA.S, the City of North Olmsted wishes to continue the eligibility in <br />the National Flood Insurance Program and in order to do so must meet the require- <br />ments of Section 1910.3 (d) of the Federal Insurance Administration regulations as <br />amended. <br />NOtiV, TFEREFORE, BE IT ORDAINED BY T'HE COUNCIL OF THE CITY OF NORTH OLM,STED, <br />COUNI'1' OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: STATUTORY AUTHORIZATION, FINDING OF FACT, <br />PURPOSE AND OBJEGTIVES. <br />A. STATUTORY AUTHORIZATIQN <br />The Ohio Constitution grants municipalities the legal authority to adopt <br />land use and control measures for promoting the public health, safety, and general <br />welfare of its citizens. <br />B. STAMMENT OF PURPOSE <br />It is the purpose of this ordinance to promote the public health, safety <br />and general welfare, and to minimize public and private losses due to £lood conditions <br />in specific areas by provisions designed to: <br />(1) Protect hwnan life and health; <br />(Z) minimize expenditure of public money for costly flood <br />control projects; <br />(3) minimize the need for rescue and relief efforts associated <br />with flooding and generally undertaken at the expense of the <br />general public; <br />(4) minimize nrolonged business interruptions; <br />(5) minimize damage to public facilities and utilities such as <br />water and gas mains, electric, telephone and sewer lines, <br />streets and bridges located in areas of special flood hazards; <br />(6) help maintain a stable tax base by providing for the nroper <br />use and development of areas of special flood hazard so as <br />to minimize future flood blight areas; <br />(7) ensure that potential buyers are notified that nronerty <br />is in an area of special flood hazard; and <br />(8) ensure that those who occupy the areas of special flood <br />hazard assLUne responsibility for their actions. <br />C. RETHODS OF REDUCING FLOOn LOSSES <br />In order to accomnlish its purposes, this ordinance includes methods <br />and nrovisions for: <br />(1) restricting or prohibiting uses zahich are dangerous to health, <br />safety, and property due to water or erosion hazards, or which <br />result in damaging increases in erosions or in flood heights or <br />velocities;
