VIOLATIONS AND PENALTIES <br />Violation of the provisions of this ordinance or failure to comply <br />with any of its requirements sha.ll constitute a misdemeanor. Any person who <br />violates this ordinance or fails to comply with any of its reQuirements (including <br />violations of conditions of and safeguards established in connection with conditions) <br />shall upon conviction thereof be fined or imprisoned as provided by the laws of the <br />City of North Olmsted. Each day such violation continues shall be considered a separate <br />offense. Nothing herein contained shall prevent the City of North Olmsed from <br />taking such other lawful action as is necessary to prevent or remedy any violation. <br />SECTION 4: ADT2INISTRATION. <br />A. ESTABLISI-DIEN'T OF DEVELOPP4IIV'T PERMIT <br />A Development Permit shall be obtained before construction or development <br />begins within any area of special flood hazard established in Section 3 B. <br />Application for a Development Permit shall be made on forms furnished by the Building <br />Commissioner and may include, but not be limited to: plans in duplicate drawn to scale <br />showing the nature, location, dimensions, and elevations of the area in c{uestion; <br />existing or proposed structures, fill, storage of materials, drainage facilities, and <br />the location of the foregoing. Specifically, the following information is required: <br />(1) elevation in relation to mean sea level of the lowest floor, <br />including basement of all proposed structures; <br />(2) elevation in relation to mean sea level to which any proposed <br />structure will be floodproofed; <br />(3) certification by a registered professional engineer or architect <br />that the floodproofing methods for any nonresidential structure <br />meet the floodproofing criteria in Section 5 F(2), (a), (i), (ii), (iii), and <br />(4) description of the extent to which any watercourse will be altered or <br />relocated as a result of proposed development. <br />B. E?EMPTION FRCJM FILING A DEVELOPMENT PERr4IT <br />An application for a Development Permit shall not be reqdred for <br />maintenance work such as roofing, painting, and basement sealing, or for <br />small development activities (except for filling) valued at less than Five Hundred <br />Dollars ($500.00). <br />C. DESIGNATION OF 'I'HE FLOOD DAMAGE PREVENTION ORDINANCE AD1`.4INISTRATION <br />The Building Corrnnissioner is hereby appointed to administer and <br />implement this ordinance by granting or denying development permit applications <br />in accordance with its provisions. <br />D. DUTIES AND RESPONSIBILITIES OF THE BUILDING CO?MAISSIONER <br />limited Duties of the Building Commissioner shall include, but are not <br />to: <br />(1) Permit Review <br />(a) Review all development permits to determine that the permit <br />requirements of this ordinance have been satisfied. <br />(b) Review all development permits to determine that all necessary <br />permits have beenobtained from those federal, state, or local <br />governmental agencies from which prior approval is required. <br />(c) Review all development permits to determine if the proposed <br />development is located within the designated floodway as <br />indicated in the Flood BoLm.dary and Floodway M[a.p of the Flood <br />Insurance Study. If the proposed development is located <br />within the designated floodway, assure that the encroachment <br />provision of Section S H(1) is met. <br />
