<br />A RESOLUTION URGING THF OHIO DEPAR'I?IENT OF CORRECTION
<br />TO SUSPEND APPLICATION OF MININIUM STANDARDS FOR JAILS
<br />IN OHIO AS APPLICABLF TO 72-HOtTR FACILITIES, AND DECLARING
<br />AN EMERGENCY.
<br />WHEREAS, the Ohio Department of Correction, under authority of O.R.C.
<br />5120.06 and 5120.10, has issued 17inimLUn Standards for Jails in Ohio, April,
<br />1978, hereinafter referred to as Jail Stanar s, anWf-IERFAS, the said Jail Standards fail to adeQuately consider the plight
<br />of many suburban connm.mities whose jail facilities, never intended as long-
<br />term facilities, are so situated as to make adoptation physically impossible,
<br />and
<br />Wf-EREA,S, in order to comply with the said Jail Standards, support must
<br />be elicited bf the Civic leaders and the entire cormnunity for the purpose of
<br />fiunding and planning necessary for extensive adaption required in many instances
<br />by the said Jai1 Standards, and
<br />WHERF.AS, in most corrnnunities in Cuyahoga County, the 72-hour facility is
<br />the most important jail needed to facilitate proper police protection services
<br />for the respective corrnnnunity, and
<br />Wf-IERF.AS, the said Jail Standards designate many nrovisions desirable
<br />for long-term facilities as mandatory upon 72-hour facilities, creating an
<br />intolerable and impossible hardship upon the local corrnnunity.
<br />NOW, TI-EREFORE, BE IT RESOLVED BY THE CQUNCIL OF T'fiE CITY OF NORTH
<br />OUISTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION l: That this Council does hereby urge the Ohio Denartment of
<br />Correction, Bureau of Adult Detention Facilities and Services, to at once
<br />suspend the application of MinimLUn Standards for Jails in Ohio, April, 1978,
<br />as it applies to 72-hour facil.ities Lmtll a more extenslve study is ma e o?
<br />the impact the said Jai1 Standards will have on the needs of local corrununities,
<br />on law enforcement rec{uirements, financial problems created, and the time neriods
<br />within which cormnunities can reasonably comply with new Jail Standards.
<br />SECTION 2: The Clerk of Council is hereby directed to forward co-Dies of
<br />this Resolution to Congressmen Ronald Mottl; State Senators Paul Imatia
<br />and Jerome Stano, and State Representatives Rocco Colonna and James Betts,
<br />urging the State Legislators to adopt a Resolution suspending the operation of
<br />the said Jail Standards applicable to 72-hour facilities.
<br />SECTION 3: That this Resolution is hereby determined to be an emergency
<br />measure necessary for the irmY?ediate preservation of the public peace, health,
<br />safetyy, and welfare of the City, and for the further reason it is irrmiediately
<br />necessary because the State of Ohio is currently reviewing the standards and
<br />prompt action is needed by Council to declare their position in this matter,
<br />and further provided it receives the affirmative vote of two-thirds of all
<br />members elected to Council, it shall take effect and be in force irrmlediately
<br />upon its passage and approval by the Mayor.
