Any individual, partnership, firm, association, <br />joint stock company, corporation or combination of individuals of <br />in whatever form or character. <br />(i) Sexual or Genital Area. Genitals, pubic hair, buttocks, <br />anus, or nerinelun of any person, or the vulva or breasts of a <br />female. <br />749.02 PEWIT RFQUIRFD. <br />(a) Business License Required. No person shall engage in or <br />carry out the business of massage unless he has a valid massage <br />license issued by the City pursuant to the nrovisions of this <br />Ordinance for each and every separate office or nlace of business <br />conducted by such person. ? <br />(b) Massagist's Permit Required. No nerson shall practice <br />massage as a massagist, emnloyee or otherwise, wlless he has a <br />valid and subsisting massagist's license issued to him by the <br />State of Ohio -pursuant to the provisions of the Ohio Revised Code, <br />governing the limited practice of inedicine. <br />749.03 FXENIPTIONS. <br />This Ordinance shall not apply to the following individuals <br />while engaged in the personal nerformance of the duties of their <br />resnective professions: <br />(a) Physicians, surgeons, chiropractors, osteopaths, or <br />physical therapists who are duly licensed to practice their <br />respective professions in the State of Ohio. <br />(b) Nurses who are registered imder the laws of the State <br />of Ohio. <br />(c) Barbers and beauticians who are duly licensed under <br />the laws of the State of Ohio, except that this exemption <br />shall apply solely to the massaging of the neck, face, scalp <br />and hair of the customer or client for cosmetic or beautifying <br />purposes. <br />749.04 APPLICATION FOR MASSAGE FSTABLISFD•T.NT LICENSE. <br />Every applicant for a license to maintain, operate, or <br />conduct a massage establishment shall file an anplication tmder <br />oath with the City of North Olmsted upon a form provided by the <br />Department of Public Safety and pay a nonrefundable annual license <br />fee, which shall be $100.00 per year or any part thereof. The <br />abplication once accented shall be referred to the Ilepartment of <br />Public Safety for investigation. Copies of the application shall <br />within five (5) days also be referred to the Building Department <br />and the Fire Department. The Departments shall within thirty <br />(30) days inspect the premises proposed to be oberated as a <br />massage establishment and shall make written vertification to <br />the Department of Public Safety concerning compliance with the <br />codes of the City of North Olmsted and State of Ohio that they <br />administer.
