The written application for such transfer shall <br />contain the same information as rec{uested herein for initial <br />application for the license. <br />749.21 SEPARABILITY. <br />(a) If any section, subsection, sentence, clause, phrase or <br />portion of this Ordinance is for any reason field invalid or uncon- <br />stitutional by any court of comnentent jurisdiction, such nortion <br />shall be deemed a separate, distinct and indenendent provision and <br />such holding shall not affect the validity of-the remaining portions <br />thereof. <br />749.99 VIOLATION AND PENALTY. <br />Every person, except those persons who are specifically ex- <br />empted by this Ordinance, whether acting as an individual owner, <br />employee of the owner, operator or employee of the operator, or <br />whether acting as a mere agent or independent contractor for the <br />owner, employee or operator, or acting as a participant or worker <br />in any way directly or indirectly who gives massages or operates <br />a massage establishment or any of the services defined in this <br />Ordi.nance without first obtaining a license or permit from the <br />City as respects massage establishments and the State as respects <br />massage licenses, who violates any provisions of this Ordinance <br />shall be guilty of a misdemeanor and upon conviction such person <br />shall be punished by a fine not to exceed One Thousand Dollars <br />($1,000.00) or by imprisonment for a period not to exceed six (6) <br />months or by both such fine and imprisonment. <br />SECTJON 2: That Ordinance No. 79-71 of the City of North Olmsted be <br />and t esame is hereby repealed. <br />V <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measureimeRately necessary for the preservation of the public health, <br />safety and welfare and for the further reason that it is imnediately necessary <br />to regulate the operation of massage parlors, and further provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />sha11 take effect and be in force imediately upon its passage and approval <br />by the Mayor. <br />PASSED : 19 <br />ATTEST: <br />?
