_ . , -, CITY OF NORTH OLMSTED ORDINANCE N0. 79-71 PAGE 11. 749.23 NAME AND PLACE OF BUSINESS No person granted a license pursuant to this Qrdinance shall operate the massage establishment Lmder a name not snecified in his license, nor sha11 he conduct business Lmder any designation or location not specified in his license. 749.24 TRANSFER OF LICENSE No license or permit shall be transferable except with the consent of the City of North Olmsted and ratified by the Director of Public Safety of the City of North Olmsted. An application for such transfer shall be in writing and sha11 be accompanied by fees prescribed in 749.04 and 749.05. The written application for such transfer shall contain the same information as requested herein for initial application for the license or permit. 749.25 SEPARABILIT'Y (a) If any section, subsection, sentence, clause, nhrase or portion of this Ordinance is for any reason held invalid or uncon- stitutional by any Court of competent jurisdiction, such portion sha11 be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. 749.99 VIOLATION AND PENALTY Every person, except those persons who are specifically exempted by this Ordinance, whether acting as an individual owner, employee of the owner, operator or employee of the operator, or whether acting as a mere agent or independent contractor for the owner, employee or operator, or acting as a participant or worker in any way directly or indirectly who gives massages or operates a massage establishment or any of the services defined in this Ordinance without first obtaining a license or permit and paying a fee to do so from the City of North Olmsted or sha11 violate any provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction such person shall be punished by a fine not to exceed One Thousand Dollars ($1,000.00) or by imprisonment for a period not to exceed six (6) months or by both such fine and imprisonment. SECTIQN 2: That this Ordinance is hereby declared to be an emergency measure immiately necessary for the preservation of the public health, safety and welfare and for the further reason that it is immediately necessary to regulate the operation of massage parlors, and further provided it receives the affirmative vote of two-thirds of all members elected to CoLmcil, it shall take effect and be in force i.mmediately upon its passage and approval by the Mayor.
