_ . , -, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 79-71 <br />PAGE 11. <br />749.23 NAME AND PLACE OF BUSINESS <br />No person granted a license pursuant to this Qrdinance shall <br />operate the massage establishment Lmder a name not snecified in <br />his license, nor sha11 he conduct business Lmder any designation or <br />location not specified in his license. <br />749.24 TRANSFER OF LICENSE <br />No license or permit shall be transferable except with the <br />consent of the City of North Olmsted and ratified by the Director <br />of Public Safety of the City of North Olmsted. An application for <br />such transfer shall be in writing and sha11 be accompanied by fees <br />prescribed in 749.04 and 749.05. The written application for such <br />transfer shall contain the same information as requested herein <br />for initial application for the license or permit. <br />749.25 SEPARABILIT'Y <br />(a) If any section, subsection, sentence, clause, nhrase or <br />portion of this Ordinance is for any reason held invalid or uncon- <br />stitutional by any Court of competent jurisdiction, such portion <br />sha11 be deemed a separate, distinct and independent provision and <br />such holding shall not affect the validity of the remaining portions <br />thereof. <br />749.99 VIOLATION AND PENALTY <br />Every person, except those persons who are specifically <br />exempted by this Ordinance, whether acting as an individual owner, <br />employee of the owner, operator or employee of the operator, or <br />whether acting as a mere agent or independent contractor for the <br />owner, employee or operator, or acting as a participant or worker <br />in any way directly or indirectly who gives massages or operates <br />a massage establishment or any of the services defined in this <br />Ordinance without first obtaining a license or permit and paying a <br />fee to do so from the City of North Olmsted or sha11 violate any <br />provisions of this Ordinance shall be guilty of a misdemeanor and upon <br />conviction such person shall be punished by a fine not to exceed <br />One Thousand Dollars ($1,000.00) or by imprisonment for a period <br />not to exceed six (6) months or by both such fine and imprisonment. <br />SECTIQN 2: That this Ordinance is hereby declared to be an emergency <br />measure immiately necessary for the preservation of the public health, safety <br />and welfare and for the further reason that it is immediately necessary to <br />regulate the operation of massage parlors, and further provided it receives <br />the affirmative vote of two-thirds of all members elected to CoLmcil, it shall <br />take effect and be in force i.mmediately upon its passage and approval by the <br />Mayor. <br />PASSED : <br />ATTEST : <br />F RENCE CAMPBELL, CLE OF COUNCIL <br /> <br />D Y H.
