. ?.._ . ... _ _ . _ _ . . ?.:. ,?. <br />.a.? <br />? <br />. ? <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 79- 65 ? <br />BY: /lUL. ?i??l:e?Yu <br />A RESOLUTION IN SUPPORT OF THE CITY OF LAKEWOOD IN <br />PENDING APPELLATE PROCEEDINGS AGAINST CLEVELAND <br />ELECTRIC ILLUMINATING COMPANY. <br />WEEREAS, The Cleveland Electric Illwninating Company has obtained a <br />decision from the Cuyahoga County Court of Common Pleas permitting construction <br />of a substation in a residentially zoned area of the City of Lakewood, on the <br />grounds that the construction of such substation is not subject to munieipal <br />regulation, , and <br />IqMREAS, the City of Lakewood has appealed said decision to the E?ghth <br />District Court of Appeals, and <br />ZNTEREAS, this Council supports the right of all Ohio municipalities to <br />regulate constructian of all buildings and structures within municipal cornorate <br />boundaries, and <br />WHEREAS, the Cuyahoga County Mayors and City r.Ianagers Association has by <br />Resolution encouraged member municipalities to support the City of Lakewood in <br />the aforesaid appellate proceedings. <br />NOW, TfIEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council expresses its support for the City of <br />Lakewoo lc? nits-efforts to obtain a reversal of the Judgment of the Court of <br />Comanon Pleas in the case captioned "The Cleveland Electric Illuminating Company <br />vs. City of Lakewood," lmown as Case No. 40410 of the Court of Appeals for <br />Cuyahaga County. <br />SECTION 2: That this Council urges other municipalities within Cuyahoga <br />County similarly to support the City of Lakewood in this endeavor. <br />SECTION 3: That the Clerk be and is hereby directed to forward a copy <br />of this Resolution to the Clerk of Council of all municipalities within Cuyahoga <br />County, and to the Secretary of the Cuyahoga County T7ayors and City Managers <br />Association. <br />SECTIQN 4: That this Resolution shall take effect and be in fprce fxom. <br />and after the earliest period allowed by law. <br />PASSED: <br />ATTEST : <br />FLORENCE CAMPBELL, CLERK OF COtJNCIL <br />DEth Y H.
